المستخلص: تبرز أهمية بحثنا هذا من حيث المشكلة التي تسود اتفاقات الإيجار في ظل التعديل السادس المرقم (56) لسنة (2000) آلا وهي عزوف المالكين (المؤجرين) عن تدوين عقود إيجارهم لدورهم السكنية أو توثيقها، ولعل السبب وراء ذلك يكمن في الأحكام القانونية التي تضمنها هذا التعديل الأخير والذي مازال نافذاً لغاية يومنا هذا.
من السمات المميزة لهذا القانون، هي خضوع العقارات المؤجرة لقاعدة الامتداد القانوني لعقد الإيجار وتعطيل تطبيق قاعدة (العقد شريعة المتعاقدين)، حيث صنف العقارات إلى نوعين، سكنية وتخضع للامتداد القانوني لمدة أقصاها (12) سنة وتجارية وصناعية وتخضع لقاعدة العقد شريعة المتعاقدين، فما تم الاتفاق عليه بشأن مدة عقد الإيجار يصار إلى إلزام المتعاقدين بها مالم يتفق المتعاقدان على تجديد عقد الإيجار صراحة أو ضمناً ويسري عليها في هذا الشأن الأحكام الواردة في القانون المدني العراقي.
أضافة إلى هذا وذاك هناك أحكام أخرى تضمنها التعديل الأخير لقانون إيجار العقار كانت السبب وراء خلق أزمة هي (أزمة العقد)، من هنا جاءت تسمية بحثنا هذا ب (أزمة عقود إيجار في ظل قانون إيجار العقار).

The importance of our research is highlighted in terms of the problem that prevails in lease agreements under the Sixth Amendment No. (56) for the year (2000), which is the reluctance of the owners (landlords) to write down or document their lease contracts for their residential homes. Perhaps the reason behind this lies in the legal provisions contained in this last amendment, which is still in force to this day. One of the distinguishing features of this law is that the rental properties are subject to the rule of legal extension of the lease contract and the disruption of the application of the rule (the contract is the law of contractors), where the real estate is classified into two types, residential and it is subject to legal extension for a maximum period of (12) years, commercial and industrial which are subject to the rule of the law of contractors. So, what has been agreed upon regarding the duration of the lease contract becomes obligatory for the contracting parties unless the contracting parties agree to renew the lease contract explicitly or implicitly and the provisions of the Iraqi Civil Code apply to it in this regard. In addition to this and that, there are other provisions included in the last amendment to the real estate lease law that were the reason behind creating a crisis that is the contract crisis, and this is the reason behind the naming of our research as (the crisis of lease contracts under the law of real estate lease). The reason behind that lies in the legal provisions contained in this last amendment which is still in effect even till today. One of the distinguishing characteristics of this law is the adherence of leased properties to the legal extension rule of the lease agreement and the suspension of the application of the law (pacta sunt servanda) where real estate is classified into two types, residential which is subject to legal extension for up to 12 years and other is commercial and industrial which is subject to the law of pacta sunt servanda. However, the agreement on the duration of the lease agreement will require the contractors to do so unless the contractors agree to renew the lease agreement explicitly or implicitly, and the provisions of the Iraqi Civil Code apply in this regard. In addition to this, there are other provisions included in the recent amendment of the leasing property law. The reason behind this was the creation of a crisis which was (crisis of contract); therefore, our research was entitled as (the crisis of lease contracts under the law of real estate lease)
