المستخلص: هذا البحث يتحدث عن الأحكام الفقهية المتعلقة بالظل، الذي هو من أعظم النعم التي أنعم الله بها على عباده، والذي جعله علامة لعباداتهم، وعونا لهم وتسهيلا لحياتهم، ولهذا تعلقت به بعض الأحكام سواء في العبادات والمعاملات، أو في الآداب والأخلاق. ونظرا لأهمية تلك الأحكام، وحاجة عموم الناس إلى معرفتها، رأى الباحث أن يجمع مسائلها، ويقوم بدراستها دراسة مقارنة، تسهيلا على الباحثين، وتقريبا للسائلين. وقد جمع الباحث المادة العلمية المتعلقة بالموضوع، ثم بين صورة المسائل المراد بحثها، ثم ذكر الأقوال الفقهية في المسائل اتفاقية كانت أو خلافية مع عرض الأدلة وبيان وجه الدلالة، ثم الترجيح مع بيان سببه. ثم ختم البحث بخاتمة تشتمل على أهم نتائج البحث وتوصياته، مع عمل الفهارس الفنية اللازمة. كما توصل الباحث إلى عدد من النتائج منها: 1-أن من مسائل العبادات التي ينبني فيها الحكم على الظل، مسألة تحديد وقت الصلاة دخولا وخروجا، وكذلك استظلال المحرم، ونذر الإنسان ترك الاستظلال عن الشمس. 2-أنه لا يجوز التبول والتخلي في الظل الذي ينتفع به الناس، وكراهة جلوس الإنسان في موضع بعض جسده في الشمس، وبعضه في الظل. 3-أن من أحكام المعاملات حكم الإجارة على الاستظلال. أما أبرز التوصيات فهي الحاجة إلى العناية بمسائل الفقه المتعلقة بقضية واحدة في أبواب متفرقة من كتب الفقهاء، كما ينبغي على عامة المسلمين التفقه في دينهم، والبحث عن حكم الشرع في مسائل حياتهم، حيث لا تجد قضية مهما صغرت إلا وللشرع فيها حكم، وخصوصا في هذا العصر الذي تميز بسهولة البحث عن المعلومة، وتوافر طلبة العلم الذين انبروا لبحث مسائله، وجمعها، وتجليتها للناس.

This research deals with the jurisprudential provisions concerning the shadow, which is one of the greatest blessings that Allah has granted to His slaves, which made it a sign of their worship, and help them to facilitate their lives, and this is related to some provisions, whether in worship and transactions, or in etiquette and morals. Given the importance of these provisions, and the need of the general public to know it the researcher decided to collect the issues related to it, and treat it with the doctrines of jurists, to make it easier for researchers to benefit from it, and almost to those who ask about the shar'i ruling to the shadow. The researcher has collected the research material related to the subject, then given picture of the issues to be discussed, and then mentioned the doctrinal statements in the matters agreement or dispute, with the presentation of evidence and showing the face of significance in it, and then weighting the views with a statement caused Then he conclude the research with a conclusion containing the most important search results and recommendations, with the work of the necessary technical indexes. The researcher also reached a number of results, including: 1- One of the issues of worship in which the ruling on the shadow is based, the question of determining the time of prayer entry and exit, as well as the occupation of the muhrim, and the vow of human leaving the sun shade. 2- It is not permissible to urinate and give up in the shade that benefits people, and hate to sit in the position of some of his body in the sun, and some in the shade. 3- One of the provisions of the transactions is the ruling on rent of shade. The most important recommendations of the research is the need to take care of the issues of jurisprudence related to one issue in different sections of the books of jurists, as the general Muslims must know about their religion, and eek the rule of Sharia in matters of their lives, where there is no small issue without the rule of Sharia, especially in this era in which the search for information is easy, and the availability of students of Sharia who have grown to discuss its issues, collect it, and make it manifestation to the people.
