فهذا البحث يدور حول أحد المستجدات العصرية المتعلقة بوسائل الاتصال والتقنية المعاصرة، ومن تلك الوسائل الهواتف النقالة (Mobile Phones) وخصوصاً الذكية منها المسماة (Smart Phones)، والتي تحتوي على الكثير من تطبيقات وبرامج التواصل ومن أشهرها وأكثرها استعمالاً برامج التراسل الفوري مثل برنامج واتس آب (Whats App) وما يشبهه، والذي يدور البحث حول الأحكام الفقهية المتعلقة به. ويهدف البحث إلى تلمس الحكم الشرعي للعديد من المسائل المتصلة باستخدام هذا البرنامج الذي عمت البلوى باستعماله، وبعض المحاذير، والمشتبهات المتعلقة به. وقد جمع الباحث المادة العلمية، ثم بين صورة المسائل المراد بحثها، ثم ذكر الأقوال الفقهية في المسائل اتفاقية كانت أو خلافية مع عرض الأدلة وبيان وجه الدلالة، ثم الترجيح مع بيان سببه، ثم ختم البحث بخاتمة تشتمل نتائجه وتوصياته، مع عمل الفهارس الفنية. وقد توصل الباحث إلى عدد من النتائج منها: أهمية موضوع أحكام برنامج التراسل الفوري (واتس آب)، وتعلقه بحياة الناس واستعمالهم المتكرر له، وأن هذا البرنامج من الأشياء المستحدثة التي ظهرت خلال السنوات القريبة الماضية، ولذا فإن حكم استعماله وأمثاله يعتمد على كيفية ذلك الاستعمال ومحتواه وغرضه، فإن كان المحتوى والغرض صالحاً ومفيداً فالحكم هنا الإباحة بناء على الأصل في الأشياء. كما أن هناك العديد من التصرفات والأمور المتعلقة بهذا البرنامج لها أحكام خاصة غير الإباحة تدور بين التحريم والكراهة. أما أبرز توصيات البحث فهي: أن على أهل العلم وطلبته بيان حكم الشرع في المسائل الحادثة والمسائل المستجدة لعامة المسلمين، مسترشدين في ذلك بنصوص الشريعة ومقاصدها، وأقوال السلف في المسائل المشابهة.
This research concerns one of the latest developments related to modern means of communication and technology, among these are mobile phones, especially Smart Phones, which contain many applications and communication programs. The most popular and popular applications are instant messaging programs such as What's App and similar, which this research revolves around jurisprudential rulings related to it. The research aims to touch the legitimate rule of many of the issues related to the use of this program, which the general needs necessitated for its use, including some of the caveats, and suspicions related to it, and clarifying the Islamic rule in it for all Muslims. The researcher collected the relevant material to the subject, then explained the issues to be examined by filming, and then mentioned the doctrinal statements in the matters of agreement or disagreement, with the presentation of evidence and the statement of the face of significance, and weighting with reason caused. Then the researcher concluded the research with a conclusion, that includes the most important search results and recommendations, with the necessary technical indexes. The researcher also found a number of results: -1The importance of the provisions of the Instant Messaging program (whats App), and its relevance to people's lives and their repeated use. -2This program is one of the new things that have emerged in the past few years. Therefore, the rule of its use and it's like depends on how it is used, its content and its purpose, if the content and purpose are valid and useful the rule here is permissibility based on law of origin in things. -3That there are many behaviors and things related to this program have special provisions that are not permissible between the prohibition and hate. The most important recommendations of the research is that: the scholars and their students must explain the ruling on shari'ah in the matters that arise and the emerging issues for the general Muslims, guided by the provisions of the Shariah and its purposes, and the sayings of the Salaf in similar matters.
