المستخلص: تناولت في هذا البحث مسألة أثر تحقيق المناط في اختلاف أحكام المعاملات المالية المعاصرة، رسوم خطاب الضمان وهدايا الحساب الجاري أنموذجاً، بحكم أن هاتين المسألتين من مستجدات المعاملات المالية، ولم تكونا معهودتين أو متصورتين قبل ذلك، ولا يوجد لهما ذكر صريح في مآخذ الفقه الإسلامي، هادفاً من ذلك إلى قضية البحث الأصلية تحقيق المناط في هذه المسائل المستحدثة، ودوره في الربط بين النص والواقع. وأثره البالغ في اختلاف الفتوى في الهيئات الشريعة والمجامع الفقهية كونه أحد أهم أسباب الاختلاف في هذه المستحدثات، مع عرض الاختلاف الفقهي، ورد المسائل المستجدة إلى أصولها، والترجيح بين الأقوال.
بغية الكشف عن مدلول تحقيق المناط بوصفه أصلاً من أصول الاجتهاد في تنزيل الأحكام الشرعية، وذلك إبرازاً للصنعة الأصولية، التي يمارسها الأصولي والفقيه في عملية التكييف الفقهي، من خلال رده المسائل المستحدثة إلى أبوابها الفقهية، والحكم على هذه المسائل بعد تحقيق مناطها، بهدف الكشف عن ثراء التشريع الإسلامي ومرونته، وقدرته على الوفاء بحاجات الناس ومصالحها.
وقد انتظم البحث في مقدمة شملت: أهمية الموضوع، وأسباب اختياره، وأهدافه، ومشكلته، ومنهجيه، ودراساته السابقة.
وثلاثة مباحث، كل مبحث ينضوي تحته عدة مطالب توضح مضمونه، وتبين مقصودة، وخاتمة فيها بعض النتائج والتوصيات التي أثمرتها الدراسة.

In this paper, I discussed the issue of the impact of the investigation into the different provisions of contemporary financial transactions, the fees for the letter of guarantee and the gifts of the current account as an example, because these two issues are of the latest financial transactions and are not previously known or perceived before that. There is no explicit mention in the sources of Islamic jurisprudence, aiming at the matter of the original research to investigate into these new issues, and its role in linking the text and the reality, its great impact in the difference of fatwa (Islamic edict) of the Shariah bodies and jurisprudential councils because it is one of the most important reasons for the difference in these innovations, with the presentation of jurisprudential difference and restoring emerging issues to their origins, and the giving preference between statements.
The goal is to reveal the meaning of the investigation as it is one of the principles of Ijtihad (deducing Islamic rulings) in extracting shar’I (Islamic legal) rulings. This is an indication of the Usulieen (Scholars of Usul al Fiqh) work practiced by the Usulieen (Scholars of Usul al Fiqh) and the jurists in the process of adapting the jurisprudence by restoring the newly innovated issues to their jurisprudential sections and giving the judgment on these issues after their investigation with the aim to reveal the richness and flexibility of Islamic legislation and its ability to meet the needs and interests of the people.
The research was organized in an introduction that included the importance of the subject, the reasons for its selection, its objectives, its problem, its methodology, and its previous studies.
The study includes three topics, each topic includes a number of questions that clarify its content, and explain its intention, and then a conclusion with some of the findings and recommendations resulted from the study.
