المستخلص: Algeria has sought, through improvements in legislative and regulatory texts concerning investment in general, many positive aspects related to the status of real estate intended for investment as well as to the investor, whether local or national. However, there are still some obstacles that prevent the stability and success of the investment process, specifically with regard to the authority of the contract that grants the right of concession against the actors in the process and the formulas used in exploiting the real estate vessel directed to the same process. All this has made us look into the concept of the privileged contract and the rights it grants to the bearer and the obligations it imposes on him? And the addition brought by the Waqf Property Administration and its management by allocating the Waqf property and using it in the investment process? What are these mechanisms and/or new patterns introduced by the Waqf Property Administration and their management to exploit waqf property, and have they actually alleviated the organizational and practical crisis suffered by industrial property in particular and investment in general in Algeria?

L Algérie a connu un grand advancement grâce à des améliorations définies par les textes législatifs et réglementaires relatifs à l'investissement en général de nombreux aspects positifs liés à l'état de l'investissement réel axé sur immobilier et ainsi que l'investisseur, qu'il soit local ou national, et pourtant il y a encore quelques obstacles pour empêcher la stabilité et la réussite du processus d'investissement, en particulier pour le contrat faisant autorité, qui accorde le droit de privilège face à des acteurs du processus et les formules utilisées dans l'exploitation du navire immobilier dirigé vers le même processus, tout cela nous a fait regarder le concept des contrats et des droits de franchise accordés au titulaire et les obligations qui lui sont imposées par? Ainsi que l'ajout fait par la gestion des propriétés Waqf et le processus d'allocation de la propriété immobilière et l'exploitation dans le processus d'investissement? Quels sont les nouveaux mécanismes et / ou styles que la gestion de la propriété Waqf a mis en place pour exploiter la propriété de dotation, et a-t-elle effectivement allégé la crise organisationnelle et pratique vécue par la propriété industrielle, notamment l'investissement en Algérie?

سعت الجزائر من خلال التحسينات التي عرفتها النصوص التشريعية والتنظيمية ذات العلاقة بالاستثمار عموما العديد من إيجابيات تعلقت بوضعية العقار الموجه للاستثمار وكذا بالمستثمر سواء محلي أو وطني ومع ذلك لا زالت هناك بعض العراقيل تحول دون استقرار ونجاح العملية الاستثمارية، تحديدا بالنسبة لحجية العقد الذي يمنح حق الامتياز في مواجهة الفاعلين في العملية والصيغ المتبعة في استغلال الوعاء العقاري الموجه لذات العملية، كل هذا جعلنا نبحث في مفهوم العقد الامتياز والحقوق التي يمنحها لحامله والتزامات التي يفرضها عليه ؟ وكذا الإضافة التي جاءت بها إدارة الأملاك الوقفية وتسييرها بتخصيص العقار الوقفي واستغلاله في العملية الاستثمارية؟ وما هي إذا هذه الأليات و/ أو الأنماط الجديدة التي جاءت بها إدارة الأملاك الوقفية وتسيرها لاستغلال العقار الوقفي وهل خففت بالفعل من حدة الأزمة التنظيمية والعملية التي يعاني منها العقار الصناعي خصوصا والاستثمار عموما بالجزائر؟
