المستخلص: Dans cet article nous analyserons comment une démarche à caractère contractuel entre l’Etat et l’opérateur privé permet de gérer, d’administrer au mieux un service public et surtout quelles sont les conditions à réunir pour s’assurer l’efficacité de ces contrats bilatéraux ? Face à des besoins en investissements de plus en plus importants et des marchés publics ne permettant plus de mener à bien tous les projets, Le recours des gouvernements aux partenariats public-privé (ppp) constitue une alternative nécessaire. En théorie, les principaux avantages découlant de l’utilisation des ppp résident dans l’optimisation du rapport coûts/résultats, la répartition des risques entre l’autorité publique et l’opérateur privé, la conservation par l’entité publique du contrôle stratégique du service, et enfin le gain à traiter avec un secteur privé expérimenté. Un état des lieux (contexte, objectifs, modalités de mise en oeuvre et les résultats observés à ce jour) du Partenariat Public Privé, actuellement mis en oeuvre dans le transport urbain algérois, sera présenté.

In this paper we analyze how to approach a contractual nature between the state and the private operator to manage, administer the best public service and especially what are the conditions needed to ensure the effectiveness of these bilateral contracts? In theory, the main benefits of using ppp resident in optimizing the cost / performance, risk allocation between the public authority and the private operator, the retention by the public entity of strategic control service, and finally gain to deal with experienced private sector. An inventory of the Public Private Partnership, currently being implemented in urban transport Algiers, will be presented.
