المستخلص: يتناول هذا البحث أثر سد الذرائع بالعملات الافتراضية (البيتكوين) أنموذجا وبيان حكمها الشرعي؛ وهي نازلة جديدة اخترقت أسواق العملات الحديثة، سد الذرائع وفتحها، حتى يتضح للمكلف سد هذه المفسدة، وإن كان بظاهرها الربح، وبيان خطورة التعامل بها لما يؤول إليه من مفاسد على الأفراد والمجتمعات، وذلك حسب ما تفحصته من المجامع والفتاوى الجماعية، وأبرزت عدة مخالفات شرعية وقانونية فيها، ثم بينت مفهوم العملة الافتراضية "البيتكوين" وحقيقتها ونشأتها وظهر لي أنها تفتقر لشروط وتحقيق خصائص النقود ووظائفها الأساسية، وبذلك تبين لي التكييف الفقهي لها وحكم التعامل بها من الناحية الشرعية، كما أوضحت الدراسة بيان أثر سد الذرائع في المتعامل بالبيتكوين، وكيف نأمن في تطبيق سد الذرائع وتفعيل الأثر الأمثل لهذه القاعدة لعدم الوقوع في المخالفات الشرعية.
ثم انتهيت إلى بيان الحلول وإمكانية التداول فيها وفق ضوابط شرعية وشروط لازمة، فإذا ما تم رفع المخالفات الشرعية والقانونية ومنها عدم جهالة المصدر والجهة الضامنة وتحقق النقدية والثمنية والتحكم بعدم اختراق محافظها الإلكترونية، والغرر الفاحش فيها والمغامرة وكون إشراف البنك المركزي عليها ليمنع استعمالها بغسيل الأموال والمعاملات المشبوهة، هنا نقول تفتح الذريعة فيصح التعامل فيها بلا مخاطر على الأفراد والمجتمعات حيث إن الأصل في الأشياء الإباحة.


This research deals with the virtual currencies and has taken Bitcoin as a model and explains its ruling in Islam to prevent from committing what may lead to sin in Islam. Virtual currency is a new introduction that has penetrated the markets of modern currencies. The research also aims at blocking means and opening them, so that it becomes clear to the person dealing with it to block this corruption, even if the profit is visible there. I also explained the dangers of dealing with the virtual currency because of the consequences for individuals and communities according to what I understood through the encyclopedia and collections of fatwas and highlighted several Shari' and legal violations in it. I further explained the concept of the virtual currency “Bitcoin”, its reality and origin. It appeared to me that it lacked the conditions and the realization of the characteristics and basic function of the currency. I also understood the jurisprudential characterization of the virtual currency and the Shari' ruling of dealing with it. The study also explained the impact of preventing the person from dealing with Bitcoin from falling in the sin, and how we can ensure its application and activate the optimal effect of this rule to avoid falling into sharia violations.
Then I ended up explaining the solutions and the possibility of trading in the virtual currency according to Shariah regulations and necessary conditions. If the Shari' and legal violations are avoided, such as having no information about the source and the guarantor body, cash and price check and control over its electronic wallet not being hacked, and exorbitant fraud and risk and the supervision of the Central Bank to prevent its use for money laundering and suspicious transactions, we can say that it is open, so it is permissible to deal with it without risks to individuals and societies since the basic principle about things is that they are permissible.
