المستخلص: هذا البحث متعلق بمسألة مهمة وهي مسألة العوامل المؤثرة في تغير الفتوى في الشريعة الإسلامية، لأنه من المقرر أن الشريعة الإسلامية – حفظها الله – راعت أحوال المكلفين وظروفهم وملابسات وقائعهم، فلم تأت أحكام الشريعة مجرد قوالب جامدة لا يراع فيها الظروف التي تحيط بالمكلفين، بل على العكس من ذلك جاءت أحكام الشريعة مرنة واسعة تراعي أحوال المكلفين وما يحيط بهم من ظروف خاصة قد تجعل الفتوى الشرعية متغيرة حسب هذه الظروف ومراعاة لهذه الملابسات. ومن جملة الأمور المؤثرة في تغير الفتوى هو تغير المصالح، فلاختلاف المصالح اعتبار في الفتيا، بل هي مؤثرة فيها تأثيرا واضحا؛ إذ جلب المصالح ودرء المفاسد أحد أهم المقاصد الشرعية، والمصالح تختلف من زمان إلى زمان، ومن شخص لآخر، ومن مكان لآخر، وقد ورد في البحث أمثلة كثيرة على ذلك، وهذا في نظري أمدح ما مدحت به الشريعة الإسلامية أنها مرنة تسع بنصوصها وأحكامها وفتواها جميع المكلفين. وقد استعمل الباحث المنهج الاستقرائي التحليلي في بيان علاقة المصالح بالفتيا من حيث تغيرها بها، وتحليل ذلك تحليلا شرعيا مناسبا. وتوصل الباحث إلى عدة نتائج لعل أهمها: أن اختلاف المصالح له أثره الواضح في تغير الفتوى، ورعاية الشريعة الإسلامية لمصالح المكلفين، وأن الشريعة الإسلامية لم تضق يوما ولن تضيق أن تسع الناس جميعا على اختلاف ظروفهم. والله أعلم.

This research is related to the important issue of the factors influencing the change of fatwa in Islamic law, because it is decided that Islamic law - God save them - took into account the circumstances of the taxpayers and their circumstances and the circumstances of their facts, did not come the provisions of the Sharia only rigid templates not take into account the circumstances surrounding the taxpayers, On the contrary, the provisions of the Shariah are flexible and wide, taking into account the circumstances of the taxpayers and their surrounding special circumstances that may make the fatwa subject to change according to these circumstances and taking into account these circumstances. Among the things influencing the change in the fatwa is the change of interests and talents. The difference of interests and responsibilities is considered in the fatwa, but it is influential in it. The interest and the prevention of evil are one of the most important legitimate purposes. The interests vary from time to time, from person to person and from place to place. , And the research contained many examples of this, and in my opinion, praise the praises of the Islamic law that it is flexible, the provisions of the provisions and opinions of all the taxpayers. The researcher used the analytical inductive method in the statement of the relationship of interests and talents in the language in terms of change in them, and analysis of this analysis is legitimate appropriate. The researcher reached several results, perhaps the most important of which is that the different interests and machinations have a clear effect on changing the fatwa, and taking care of the Islamic Sharia for the interests of the taxpayers, and considering the tasks of the matter, and that Islamic law has never been narrowed. God knows.
