|a الزواج هو العقد الذي يربط بين الرجل والمرأة غايته إنشاء رابطة للحياة المشتركة والنسل، لذا يشترط أن يكون عقد الزواج واضحا ومفهوما للطرفين وغير غامضا أي أن تكون غايته الاستقرار والدوام للأبد وأن لا تكون هنالك وقت محدد أو غايات معينة كما هو الحال في الزواج المؤقت والزواج المحلل لأنه لو تضمن عقد الزواج لوقت محدد أو غاية معينة فإن عقد الزواج يكون غير صحيحا.\nكذلك الحال بالنسبة للطلاق فإن الطلاق هو حل عقد الزواج بألفاظ محددة ومخصصة له شرعا في الحال أو المآل ويشترط أن يكون إيقاع الطلاق بالألفاظ المخصصة له شرعا دون النظر إلى النية الزوج عند الطلاق لأن النية مسألة كامنة في النفس ومن الصعوبة الاطلاع عليها أو إثباتها، ولأنه قد يكون الزوج في حالة غضب ويطلق زوجته بألفاظ كنائية وينوي ذلك ولكن قد يهدأ الزوج ويندم ويدعي أنه لم يكن ينوي تطليقها حينها يكون من الصعوبة معرفة نيته، ولا يجوز للزوج أن يوقع الطلاق بالحلف لأن هذا الأمر غير جائز شرعا وقانونا.\nففي جميع الحالات الغامضة التي تم ذكرها سواء في الزواج أو الطلاق يجب أن يزال الغموض في ذلك الحالات لكي يكون الزواج أو الطلاق صحيحا وغير غامضا وبرتب آثاره القانونية والشرعية.

|f Marriage is a contract that links a man and a woman and whose purpose is to establish a bond of shared life and a bloodline. Therefore, it is required that the marriage contract be clear and understandable to both parties. It should not be ambiguous. The purpose should be settling and lasting forever. There should be no specific time period or certain goals, such as temporary marriage and Nikah Halala. If the marriage contract involves a particular period of time or a particular purpose, the marriage contract would be invalid.\nDivorce is the dissolution of the marriage contract in specific and Shari’ allocated terms at once or for all. It is required that the happening of divorce should be by the terms that are assigned to it in Shariah, without any regard to the husband's intention at the time of divorce, because the intention is a matter inherent in the soul. It is difficult to see or prove the intention. The husband could divorce his wife in non-exclusive terms while he is in a state of anger, and while he intends to do so. The husband may later calm down and regret and claim that he did not intend to divorce her, and at that, it would be difficult to know his intention. It is not permissible for the husband to divorce by swearing because it is not permissible in shariah and law.\nIn all the ambiguous cases mentioned in marriage or divorce, the ambiguity must be removed in such cases so that the marriage or divorce is valid and unambiguous and has shari' and legal effects.\nThis abstract translated by Dar AlMandumah Inc. 2018
