|a يعتبر المجلس الدستوري هيئة دستورية رقابية، مهمته الأساسية هي الرقابة على دستورية القانون، انطلاقا من مبدأ سمو الدستور، وخضوع باقي القوانين له، وقد شمله التعديل الدستوري 2016 بجملة من التعديلات تصب كلها في محاولة تعزيز دوره وتكريس استقلاليته وحياده. إلا أن هذه الاستقلالية تبقى محدودة خاصة في ظل هيمنة السلطة التنفيذية على هذا المجلس، كما أن غياب سلطة الإخطار الذاتي للمجلس جعلت عمله رهينة بسلطة الإخطار التي تمارسها السلطات الدستورية المخولة بذلك، مما أثر على دوره الرقابي واستقلاليته وحياده

|d Le Conseil constitutionnel est un organisme constitutionnel dont la tâche principale est de contrôler la constitutionnalité de la loi, sur la base du principe de la suprématie de la Constitution, et la subordination des autres lois, et a été amendé par l'amendement constitutionnel de 2016 avec un certain nombre des amendements, en essayant de renforcer son rôle et de consacrer son indépendance et sa neutralité.
