المستخلص: The issue of food safety has become a large part of the attention of individuals and authorities alike, as a result of the increase in nutritional awareness and the great scientific progress during the current century, especially in the health awareness of the individual and the knowledge of many diseases that may affect him as a result of eating spoiled or adulterated food. These dangers have been exacerbated with the emergence of new industries, including processed or semi-processed food, and the emergence of food establishments on a large commercial scale, not to mention the prevalence of food places and fast-food restaurants and the increase in the number of people who eat their food outside their homes, which led to the search for the best ways to extend the life of food by using preservatives in foods and industrial materials in food production, in addition to the introduction of new technologies in food preservation and processing methods. This leads us to ask the extent to which the Algerian legislature has been able to contain these phenomena by regulating all legal aspects to ensure that the consumer obtains a healthy food item that conforms to the approved specifications and standards. This will be answered through two main points. In the first, we will study the concept of commitment to food safety, and in the second, we will address the obligations of the intervention in the field of ensuring food safety by regulating the scientific material available to us according to a methodological framework based mainly on the descriptive analytical approach in the integration of multiple data.

Le sujet de la sécurité alimentaire est devenu une grande partie de l’intérêt des individus et des autorités. Ce qui est consécutif à l’élargissement de la sensibilisation nutritionnelle et le développement scientifique foudroyant que témoigne ce siècle, surtout dans le domaine sanitaire de l’individu et la conscience des maladies capable de l’atteindre à cause des consommations des aliments pourris. Ces risques se sont aggravés par l’apparition de nouveaux produits comme les aliments prés à consommer, les produits semi- élaborés et l’établissements des institutions alimentaire sur un champs commercial large, ainsi que la prolifération des lieux de vente alimentaire, de restaurants, fast-food et l’augmentation du nombres des personnes prenant leurs repas en dehors de chez sois. Ce qui a abouti à la recherche des meilleurs moyens pour conserver la matière alimentaire en utilisant les additifs et les produits industriels. En outre, l’emploie de nouvelle techniques de conservation et de traitement alimentaire. Cela ne conduit à questionner la capacité du législateur algérien de contenir tout ces phonèmes par l’organisation de tout les aspects juridique pour assurer l’obtention du consommateur des aliments plus sures correspondant aux caractéristiques et normes certifiés. On accède à y répondre par deux parties principales dont on traite dans l’une le concept l’obligation de la sécurité alimentaire et son contrôle tout en respectant ses exigences dans l’autre partie par la mise au point de la matière scientifique disponible selon un cadre systématique qui est basé sur une approche descriptif et analytique dans la combinaison des données différentes.

أصبح موضوع سلامة الغذاء جزءا كبيرا من اهتمام الأفراد والسلطات على حد سواء، نتيجة لزيادة الوعي الغذائي والتقدم العلمي الكبير خلال القرن الحالي خاصة في مجال الإلمام بصحة الفرد ومعرفة الكثير من الأمراض التي قد تصيبه نتيجة تناول الأغذية الفاسدة أو المغشوشة، فقد تفاقمت هذه الأخطار مع ظهور صناعات جديدة منها الغذاء المجهز أو نصف المجهز، ونشوء مؤسسات الأغذية على نطاق تجاري واسع، ناهيك عن انتشار أماكن بيع الأغذية ومطاعم الوجبات السريعة وازدياد عدد الأشخاص الذين يتناولون غذاءهم خارج منازلهم، الأمر الذي أدى إلى البحث عن أفضل السبل لإطالة عمر المادة الغذائية باستخدام المواد الحافظة في الأطعمة والمواد الصناعية في إنتاج الغذاء بالإضافة إلى دخول تقنيات جديدة في طرق الحفظ والمعالجة الغذائية، وهو ما يدعونا إلى طرح التساؤل حول مدى تمكن المشرع الجزائري من احتواء هذه الظواهر من خلال تنظيم كافة الجوانب القانونية لضمان حصول المستهلك على مادة غذائية سليمة ومطابقة للمواصفات والمعايير المعتمدة. وهو ما ستتم الإجابة عليه من خلال محورين أساسيين، حيث ندرس في الأول مفهوم الالتزام بالسلامة الغذائية ونتطرق في الثاني إلى الالتزامات الواقعة على عاتق المتدخل في مجال ضمان السلامة الغذائية وهذا عن طريق ضبط المادة العلمية المتوفرة لدينا وفق إطار منهجي يستند أساسا على المنهج الوصفي التحليلي في الدمج بين معطيات متعددة.
