المستخلص: Given the Algerian state’s interest in foreign investment in recent years, on the one hand, by adopting mechanisms that can achieve a qualitative leap for the national economy, the Algerian legislature has implemented a legal system to be a frame of reference that determines the legality of foreign investment by organizing it objectively and procedurally for achieving the established objectives of approval within the economic policy options in the state. So, what is the concept of foreign investment, what are the guarantees and incentives for those involved in it, and what is the role of investment agencies in foreign investments to respond to the ambitions in achieving its existence and effectiveness in answering this problem? The first point addresses the concept of foreign investment. The second one is about guarantees of foreign investment in Algeria and its incentives. The third one deals with the role of the investment bodies in foreign investments.

نظرا لاهتمام الدولة الجزائرية في السنوات الأخيرة بالاستثمار الأجنبي، من جهة اعتمادا آليات التي يمكن أن تحقق قفزة نوعية للاقتصاد الوطني، قام المشرع الجزائري بتفعيل منظومة قانونية لتكون إطارا مرجعيا يحدد مشروعية الاستثمار الأجنبي بتنظيمه موضوعيا وإجرائيا لغرض تحقيق الأهداف المسطرة من إقرار ضمن خيارات السياسية الاقتصادية في الدولة فما هو مفهوم الاستثمار الأجنبي وما الضمانات والحوافز المسخرة للقائمين به وما هو دور أجهزة الاستثمار في الاستثمارات الأجنبية لتستجيب للطموحات المعقودة عليه في تحقيق وجوده وفاعليتها للإجابة عن هذه الإشكالية تتعرض في المحور الأول لمفهوم الاستثمار الأجنبي والثاني ضمانات الاستثمار الأجنبي في الجزائر وحوافزه الثالث وما هو دور أجهزة الاستثمار في الاستثمارات الأجنبية.

En raison de l’intérêt de l’Etat algérien pour l’investissement étranger au cours des dernières années, d’un côté l’adoption de mécanismes qui peuvent réaliser un pas en avant pour l’économie nationale. Alors le législateur algérien a pris en charge la disposition d’un système juridique comme cadre référentiel déterminant la laïcité de l’investissement étranger et qui l’organise sur le fond et la procédure pour la réalisation des objectifs prédéfinis pour son approbation dans les options des politiques économiques de l’Etat.
Donc, quel est le concept de l’investissement étranger et quelles sont les garanties et les incitations disponibles pour répondre aux aspirations qui lui sont confiées dans la réalisation de son existence et son efficacité.
Et pour répondre à cette problématique, nous allons exposer, dans le premier chapitre, le concept de l’investissement étranger, dans le deuxième, les garanties et leurs incitations, et le troisième est consacré au rôle des organismes chargés de l’investissement.
