المستخلص: هدف البحث إلى الكشف عن أوجه القصور في البنية القانونية المحددة بالقانون رقم (18) لسنة 1995م وتعديلاته بشأن الجماعات اليمنية وبعض التشريعات ذات الصلة، والمترجمة واقعيا في شكل التنظيم الإداري للجامعات اليمنية الحكومية، حيث تعد دراسة التنظيم الإداري من الأهمية لتحقيق أهداف أي منظمة، فالتنظيم هو الإطار الذي يقرر الوظائف التي تمتلك القوة، واللي على ضوؤها يتم اتخاذ القرارات. وبما أنه لا توجد دراسة محلية ذات صلة ببيان إشكاليات الهياكل التنظيمية كما تشرحها القوانين ذات الصلة سواء في الجامعات الحكومية أو الخاصة، كان التوجه بالبحث نحو الجامعات باعتبارها مؤسسات تربوية لها دور متميز في تنمية المجتمع وتطويره في كافة المجالات، وهذا الدور يظهر في نوعية العمل الذي تؤديه الجامعة، وأسلوب نشاطها، وطريقة أدائها لواجباتها، وفي هذا الصدد يجب أن نفرق بين ما هو كائن وما هو ممكن، ما بين الواقع والمأمول، وفي كثير من الجامعات نجد أن ما يحصل في الواقع من أنشطة بعض الجامعات لا يعبر عن دور الجامعة الحقيقي، وطالما أن بلادنا تعد من الدول السائرة في درب التنمية وتحاول أن تضع لنفسها موطئ قدم ، فإن الدور الذي يجب أن تقوم به الجامعة في تنمية المجتمع اليمني، يجعل من الضروري أن نبحث في نشاطها الذي يتم من خلال تنظيمها الإداري ونكشف عن مكامن الخلل والقصور لمعالجتها وتطويرها إلى الأفضل.
وقد تم استخدام خطوات المنهج القانوني في هذه الدراسة التربوية باعتبار الجامعة مؤسسة تربوية، ويضاف إلى ذلك العمل على تحليل التشريعات تحليلا كيفيا.
وعلى ضوء مشكلة البحث وأهدافه والمنهج المستخدم فإنه تم تناول الموضوع والإجابة عن أسئلة البحث في المبحثين الآتيين:
• المبحث الأول: تناول مكونات التنظيم الإداري للجامعات: المبادئ والوظائف والأهداف وعلاقته بالإدارة الحكومية.
• المبحث الثاني: تناول البنيان القانوني للتنظيم الإداري للجامعات الحكومية وأوجه القصور والتناقضات فيه.
وتوصل البحث من خلال استخدام المنهج القانوني إلى نتائج منها: وجود كثير من المشكلات التي يبرر وجودها وجود أخطاء ما في مدخلات النظام الجامعي مثل: التخطيط، وبناء لتنظيم، وتوزيع السلطة والمسئولية وكل هذا يلقي الضوء على جوانب من النظام الجامعي والخلل الذي قد يعاني منه لا سيما في تنظيمه الإداري وبنيته القانونية. وأوصى البحث: بوضع فلسفة واضحة لما نريده من التعليم الجامعي والإدارة الجامعية التي على ضوئها يتم التخطيط لتطوير تنظيمها الإداري وإصلاحه.
ولعل نتائج البحث الحالي يمكن أن تعد قاعدة أساس لمعالجة المشكلات التي لا تزال قائمة في الهياكل التنظيمية أو في توزيع المهام والاختصاصات في الجامعات اليمنية الحكومية.

The research aims to reveal shortcomings in the legal structure specified by Law No. 18 of 1995 and its amendments concerning Yemeni groups and some relevant legislation, which is realistically translated into the administrative management of Yemeni public universities. The study of administrative management is important to achieve the goals of any organization. The organization is the framework that identifies the functions which have the power and in light of which the decisions are made. Since there is no local study related to the problems of organizational structures as explained by the relevant laws, whether in public or private universities, the approach has been to research universities as educational institutions that have a distinct role in the development of society in all fields. This role is evident in the quality of the work performed by the university, the style of its activity, and the way it performs its duties. Therefore, we must differentiate between what is existing and what is possible, and between reality and hope. In many universities, we find that the activities being carried out in some universities do not reflect the true role of the university. As long as our country is counted among the countries, which are on the development path and are trying to make a foothold, the role that the university must play in the development of Yemeni society makes it necessary to look into their activity, which is carried out through its administrative organization. We must also reveal the shortcomings and limitations to address them and develop these universities for the better.
This educational study used the steps of the legal curriculum by considering the university as a pedagogical institution. We also added the work on a qualitative analysis of the legislation.
In light of the study problem, its objectives, and the methodology used, the study addressed the topic and answered the questions in the following two chapters:
• First Chapter: It discussed the components of administrative management of universities: principles, functions, objectives, and relationship with the government administration.
• Second Chapter: It addressed the legal structure of the administrative management of public universities and its shortcomings and contradictions.
Through the use of the legal approach, the research reached several results, including:
The presence of many problems justifies the existence of errors in the entries of the university system, such as planning, building the management, distribution of authority, and responsibility. All this sheds light on the aspects of the university system and the malfunction that it may suffer from, especially in its administrative organization and legal structure.
The study recommended establishing a clear philosophy of what is needed from university education and university management in the light of which the development and reform of its administrative management should be planned.
The current study results may serve as a basis for addressing the problems that still exist in organizational structures or the distribution of tasks and competencies in Yemeni government universities.
