|a تهدف هذه الدراسة إلي توضيح دور محكمة العدل الدولية كجهاز قضائي دولي من خلال قراراتها وآرائها الاستشارية في تطوير قواعد القانون الدولي الإنساني، لاسيما من خلال المسؤولية الجنائية عن انتهاكات الجسيمة للقانون الدولي الإنساني، وتعويض الضحايا عما لحقهم من أضرار جراء هذه الانتهاكات وهذا من جانب المسؤولية المدنية، فالمحكمة رغم أنها ليست مختصة بصفة مباشرة في تنفيذ القانون الدولي الإنساني، إلا أنها تساهم بطريقة غير مباشرة في تنفيذ قواعد القانون الإنساني نظرا لتمتع فتواها بأهمية قانونية تقيد تصرفات الدول وتحثها على احترام قواعد القانون الإنساني.

|b This study aims at clarifying the role of the International Court of Justice as an international judicial body through its decisions and advisory opinions in the development of the rules of international humanitarian law, particularly through criminal responsibility for serious violations of international humanitarian law and compensating the victims for these violations Although the Court is not directly competent in the implementation of international humanitarian law, it indirectly contributes to the implementation of the rules of humanitarian law because its advisory opinion is of legal importance to restrict the actions of States and urges them to respect the rules of humanitarian law.
