وبعد:
فالمال قوام الحياة وهو من أهم أساليب عمارة الأرض، واستخلاف الله عز وجل بعض الناس
عليه لقوله تعالى:
"لا تؤتوا السفهاء أموالكم التي جعل الله لكم قياماً وازرقوهم فيها واكسوهم وقولوا لهم قولاً مروفاً".
يعمل المال العام على تطوير المنظومة الاقتصادية بالدولة، حيث يعد وسيلة هامة من وسائل الدولة الحديثة للقيام بأنشطتها المختلفة من إنشاء مرافق عامة وتسييرها وتحقيق النفع العام، فتقوم الدولة بوضع الخطط المستقبلية التي تهدف إلى تحقيق أغراض التنمية المستدامة في جميع المجالات استناداً إلى توافر المال العام، وتسعى إلى حماية المال العام من خلال أنظمة وضعية رادعة لكافة صور الاعتداء عليه، فرغم تعدد أنظمة الحماية المتعارف عليها تنتشر صور التعدي بشكل متفاوت بين المجتمعات، وقد يرجع ذلك إلى عدم تفعيل هذه القوانين أو عدم كفايتها.
وجاء المنهج الإسلامي بشريعة كاملة صالحة لأي مكان وزمان لحفظ المال العام وحمايته والنهي عن الاعتداء عليه، واعتباره جزءاً من المقاصد الخمسة الضرورية.
ونظراً لهذه الأهمية البالغة للمال العام تهدف هذه الدراسة لبيان دوره في الدولة الحديثة، ومعرفة صور الحماية القانونية له، وسبل الحد من الاعتداء عليه، وعرض ما جاء بالمنهج الإسلامي للاستفادة من مسلكه نحو تحقيق الحماية الفعالة لهذا المال، حيث أن الشريعة الإسلامية هي المرجعية الأصلية لكافة القوانين الوضعية.

Praise be to Allah, the Lord of the Worlds and blessings and peace be upon the most honourable Messenger, our master Muhammad, and his family and all of his companions.
Money is the strength of life, which is one of the most important methods of building the earth, and Allah, may He be glorified and exalted, gives succession to some people over it. Allah says:
And do not give away your property which Allah has made for you a (means of) support to the weak of understanding, and maintain them out of (the profits of) it, and clothe them and speak to them words of honest advice.
Public money works on the development of the economic system in the country, as it is an important means of a modern state to carry out its various activities such as the establishment and operation of public facilities and the achievement of public benefit. The State formulates future plans aimed at achieving sustainable development objectives in all areas based on the availability of public funds and seeks to protect public funds through systems that deter all forms of aggression against it. Despite the many customary protection systems, abuses spread unevenly across communities, and this may be due to the ineffectiveness or inadequacy of these laws.
The Islamic approach comes with a full Sharia (Islamic legal law) that is valid for any place and time to preserve and protect public money and forbid harmful activity on it, and considers it to be part of the five essential purposes.
In view of this great importance of public money, this study aims to demonstrate its role in the modern state, to find out the forms of legal protection for it, and ways to reduce its abuse and to present the Islamic method to benefit from its approach towards achieving adequate protection of this money as Islamic law is the original reference for all positive laws.
