|a تدخل الدستور بتنظيم السياسة الجنائية أصبح ضرورة ملحة أملتها الحاجة الماسة إلى الحد من تفشي الظاهرة الإجرامية داخل المجتمع؛ باعتباره التشريع الأسمى في الدولة لذي لا يجوز مخالفة أحكامه. وبخاصة في ظل التغيرات الحديثة التي شهدتها مصر ووضعها للدستور المعدل عام 2014، وجدنا ظهور العديد من التوجهات نحو إتباع سياسة جنائية حديثه، هدفها الوقاية والردع معا. فهنا كفي نصوصه وأحكامه ما تم استحداث وتعديل ما لم يكن موجودا في الدساتير السابقة كآلية مكافحة الإرهاب وعقابه بكافة أشكاله كما هو موجود حالياً، كذلك سياسة الردع والزجر لمن يحرض على العنف أو التمييز بين المواطنين والطعن في الأعراض وحظر صور استغلال الجسد البشري كالعبودية وتجارة الجنس والبشر والاستغلال الجنسي وغيرهم من التوجهات نحو سياسة جنائية حديثة.
