|a شمل الخلاف الفقهي لمعارضة دليل القياس (80) مسألة، تم حصرها في هذا القسم لكتاب بداية المجتمع ونهاية المقتصد، وهي شاملة لكتاب: الطهارة من الحدث، والصلاة، والزكاة، الصيام، والحج، و(الجهاد، والإيمان، والنذور، والضحايا، والذبائح، والصيد، والعقيقة، والأطعمة والأشربة). وعدد المسائل المختلف فيها في لمعارضة دليل القياس، قليلة بالنسبة لعدد المسائل المختلف فيها في لمعارضة دليل القياس، قليلة بالنسبة لعدد المسائل في كتاب بداية المجتهد ونهاية المقتصد لابن رشد – رحمة الله، فمسائل الكتاب المختلف في هذا القسم قرابة (900) مسألة، بينما عدد المسائل في نفس القسم لمعارضة دليل القياس (80) مسألة فقط. وجرت عادة ابن رشد – رحمة الله – في كتابه، أن ينص صراحة على مخالفة دليل القياس للأدلة، وذلك عند ذكر سبب الخلاف في المسائل التي فيها معارضة بسبب دليل القياس. والراجح في أغلب المسائل التي نص فيها المؤلف – رحمة الله – أن سبب الخلاف لمعارضة دليل القياس، الغالب أن الراجح فيها لجهة من أخذ بدليل القياس، فقد وجه المؤلف – رحمة الله – القياس بطريقة فريدة. واغلب المسائل التي فيها سبب الخلاف لمعارضة القياس، وجدت القياس فيها يوافق الأثر.

|b The fiqh dispute included the opposition of the measuring guide (٨٠), which is summarized in dis section of the book of the beginning of the diligent and the end of the saving. It is comprehensive of the book: Purity of the event, prayer, zakat, fasting, Hajj and Jihad, faith, vows, Fishing, aqeeqah, food and drinks). And the number of different issues in opposition to the measurement manual, few for the number of issues in the book of the beginning of diligence and the end of the prudent Ibn Rushd - may God have mercy on him -, the issues of different writers in dis section about (٩٠٠) issue, while the number of issues in the same section To oppose the measurement manual (٨٠) only question. Ibn Rushd, may God have mercy on him, usually wrote in his book dat it explicitly states dat the evidence for measuring the evidence should be violated when mentioning the reason for disagreement in matters of opposition coz of the measuring evidence. In most of the cases in which the authors - may God have mercy on him - said dat the reason for disagreement to oppose the measuring guide, most likely dat the most likely to take the measure of measurement, the author - may God have mercy on him - measurement in a unique way. Most of the issues in which the dispute was caused by the opposition to the measurement, where the measurement was consistent wif the effect.
