المستخلص: يهدف هذا المقال إلى إبراز المبررات الموضوعية والقانونية التي تستلزم أن يكون للقضاء الجزائري دور في الرقابة على دستورية القوانين أكثر من مجرد غربلة أو تصفية الدفوع بعدم الدستورية كما هي في النموذج الفرنسي. لقد تبين من خلال التحليل أن مجموعة من المبررات، كالمساواة بين السلطات وعدم التمييز ضد القضاء واعتبار القضاء سلطة وأنه الحامي للحقوق والحريات، تستدعي الاعتراف للقضاء بدور في الرقابة على دستورية القوانين. بالإضافة إلى الاستفادة من تجارب الدول الأخرى التي استبدلت المجالس الدستورية بمحاكم دستورية. وتوجه الغالبية الساحقة لدول العالم إلى القضاء في الرقابة على دستورية القوانين. وأن رقابة الدستورية عن طريق مجلس دستوري لا تطبق إلا في فرنسا وبعض مستعمراتها.

This article aims at highlighting the objective and legal justifications that require the Algerian judiciary to play a role in controlling the constitutionality of the laws rather than just screening or dismissing the arguments of unconstitutionality as in the French model. The analysis found that a range of justifications, such as equality of powers and non-discrimination against the judiciary, the judiciary as a power and guardian of rights and freedoms, call for the judiciary to recognize a role in monitoring the constitutionality of laws.. In addition to benefiting from the experiences of other countries that replaced the constitutional councils with constitutional courts. The vast majority of the world's countries are directed to the judiciary in monitoring the constitutionality of laws.
