المستخلص: جاء الإسلام بتشريعات عظيمة حمت الإنسان، وحفظته، وحققت له السلم في الأرض التي يعيش عليها، وكفلت له حق الحياة الكريمة ومنحته الحرية التامة التي على أساسها كان تكليفه، وبها نال حق الاختيار في كسبه، فكانت الشريعة الإسلامية -بحق- سياجا منيعا، وحصنا حصينا للإنسان، ومن القواعد المقررة شرعا: أن المحافظة على النفس هي إحدى الضروريات الخمس، والعناية بعقله وبدنه، وماله، وعرضه، ودينه، بلغت غايتها، ولقد قرر الأصوليون ذلك في كتبهم، ونصوا على أن الضروريات الخمس، والمقاصد الكلية تتمثل في المحافظة على النفس، والدين، والعرض، والعقل، والمال، وغاير بعضهم فقال: المحافظة على النسب بدلا عن العرض. بل إن تكاليف الشريعة كلها ترجع في وصفها إلى حفظ مقاصدها في الخلق، وهذه المقاصد تتنوع حسب أهميتها بالنسبة للمكلف إلى ثلاثة أقسام: ضروري، وحاجي، وتحسيني، وجميعها تتعلق ببيان مدى اهتمام الشارع في وضعه للشريعة بالنسبة لهذا الإنسان المكرم المكلف. وليست مقاصد الشريعة قاصرة على حماية المؤمن بها، بل تتعداه، فتتناول بحمايتها كل نفس -كما علمت- وبهذا نطقت أحاديث النبي صلى الله عليه وسلم عند ذلك: ما رواه أبو داود، والنسائي عن أبي بكرة قال: سمعت رسول الله صلى الله عليه وسلم يقول: "من قتل معاهدا في غير كنهه حرم الله عليه الجنة". وفي رواية أخرى لأبي داود: (من قتل رجلا من أهل الذمة لم يجد ريح الجنة، وإن ريحها ليوجد من مسيرة سبعين عاما). وفي البخاري في هذا الحديث: (وإن ريحها ليوجد من مسيرة أربعين عاما). خرجه من حديث عبدالله بن عمرو بن العاص. إلى غير ذلك من الأحكام التي قررتها الشريعة حماية للإنسان كالقصاص من الجاني، وتحذير الناس، وتخويفهم من عواقب الاستهانة والإهمال في حماية النفس حتى ولو على سبيل الخطأ، وما في حكمه، وما أعدته الشريعة من العقوبات الأخروية الرادعة.
