|a عنوان البحث: الترجيح بالحاجة عند الأصوليين وأثره في الفروع الفقهية \nخطة البحث: تشتمل على مقدمة، وخمسة مباحث، وخاتمة. \nالمقدمة: وفيها أسباب اختيار الموضوع، ومنهج البحث، وخطة البحث. \nالمبحث الأول-تعريف الترجيح وشروط وأسبابه وحجيته وفيه أربعة مطالب: المطلب الأول: تعريف الترجيح. المطلب الثاني: شروط الترجيح. المطلب الثالث: أسباب الترجيح. المطلب الرابع: مذاهب العلماء في الترجيح بين الأدلة المتعارضة. \nالمبحث الثاني-تعريف الحاجة وأسبابها وشروطها وأقسامها وفيه أربعة مطالب: المطلب الأول: تعريف الحاجة. المطلب الثاني: أسباب الحاجة. \nالمطلب الثالث: شروط الحاجة. المطلب الرابع: أقسام الحاجة. المبحث الثالث-الفرق بين الحاجة وما يشتبه بها. \nالمبحث الرابع -حجية الحاجة وأدلة مشروعيتها وفيه مطلبان: المطلب الأول: أقوال العلماء في حجية الحاجة. المطلب الثاني: أدلة الأقوال. \nالمبحث الخامس-الآثار المترتبة على الترجيح بالحاجة عند الأصوليين وفيه المسائل الآتية: المسألة الأولى: المنهي عنه لغيره يباح للحاجة، والآثار المترتبة على ذلك. المسألة الثانية: مخالفة الحاجة لمقياس، وأثر ذلك في الأحكام الشرعية. المسألة الثالثة: ارتفاع حكم الكراهية بمقتضى الحاجة، وأثره في الأحكام الشرعية. المسألة الرابعة: الترخص بسبب الحاجة، والآثار المترتبة على ذلك. المسألة الخامسة: الترخيص بالحاجة لا ينطبق قبل وقوع الحاجة، والآثار المترتبة على ذلك. المسألة السادسة: تغير الأحكام بتغير الحاجة، والآثار المترتبة على ذلك. المسألة السابعة: التصرف في مال الغير مع تعذر استئذانه للحاجة، وأثر ذلك في الفروع الفقهية. \nالخاتمة: وتشتمل على أهم النتائج.

The fourth point: the doctrines of experts in weighting between conflicting evidence. \nThe second topic - the definition of the need and its causes and conditions and sections and there are four points: The first point: the definition of the need. Second point: reasons for the need. \nThird point: conditions of the need. Fourth point: sections of need. The third topic - the difference between need and what is suspected. \nThe fourth topic - the authenticity of need and evidence of its legitimacy and there are two points: The first point: the statements of scholars in the authenticity of need — the second point: evidence the statements. The fifth topic - the implications of weighting by the need among the fundamentalists and there are the following issues: The first issue: what is forbidden to others is permissible for the need and the implications of that. The second issue: to violate of the need for a measure, and its impact on the provisions of Islamic law. The third issue: the rise of hate rule by the need, and its impact on the rulings of Sharia. The fourth issue: giving permission due to need, and the implications of that. The fifth issue: giving permission due to need does not apply before the need arises, and the implications of that. The sixth issue: Change of provisions by the change of needs, and its implications.
