إن لغزو الفضاء إيجابيات جعلت من العالم صورة أكثر معرفة وإشراقا. وكان لعلماء الفضاء الدور الأكبر في اكتشاف الفضاء وسبر أعماقه، ومما زاد من إنتاج العلوم والمعارف التي تطور من مناهج الحياة في كافة المناحي، إلا أن الخطر قد يصبح وشيكا في ازدياد الغزو في المركبات الفضائية، مع ازدياد عدد الرحلات التي من النتيجة بمكان أن تؤدي إلى سقوطها وإحداث آثار بليغة في أي مكان تسقط فيه، من أضرار مادية أو معنوية. وعليه بدت الحاجة ماسة لمواجهة تلك المخاطر، مع الأخذ بعين الاعتبار أن وجود القواعد العامة في القوانين ومنها قانون المعاملات المدنية الإماراتي أعطت مجالا للمعرفة على المستوى الوطني بأن أفردت بعض النصوص المتعلقة بالمسؤولية التقصيرية. لذا استلزم علينا في هذه الدراسة: 1- تسليط الأضواء والكشف عن مدى احتمالية وقوع الأضرار من قبل المركبات الفضائية سواء المحلية مثل وكالة الإمارات للفضاء أو العالمية وكيفية التعامل معها. ومن حيث وضع معايير خاصة للسلامة والمواصفات الفنية كتدبير احترازي فعال وكذلك لمعرفة تبعات الآثار الناتجة عن سقوط المراكب الفضائية. 2- النظر إلى استحداث قواعد قانونية تتلاءم مع المخاطر التكنولوجية الحديثة، والطبيعة الخاصة للأضرار التي تحدثها المركبات الفضائية في حال سقوطها على بقعة معينة.
Discovery of Space has its objectives that made the world an image of more knowledge and shining. The scientists of the space had the biggest role in the space discovery and know its depths, the thing which increased the production of sciences and education which develop the lifestyles in all aspects. But danger could be near in the increase of the number of trips of the space vehicles which may result in its fall and to the occurrence of huge results in any place such space vehicles may fall in, materialistic or moral damages. Thereupon, the need has become necessary to confront such dangers, taking into consideration the availability of general regulations in Laws such as the Emirates Law of Civil Transactions, which have given a space for knowledge on the national level by giving some contexts, related to the tort. Therefore, in this study, have to: 1- Focus the lights and discover what the possibility of the occurrence of some of the damages from the space vehicles, whether the domestic, such as Emirates Space Agency, or the international, and how to deal with them. By deciding a special criteria for the safety and technical specification as a precautionary measure effectively and to know the consequences of the impacts arising from the fall of space vehicles. 2- Consider new legal regulations that suit modern technological risks, and the nature of the damages the space vehicles occur in case falling on a certain spot.
