|a تفرض حركية المجتمع الدولي وطبيعته المتغيرة إضفاء نوع من المرونة وعدم التخصيص والتقييد لبعض نصوصه لكي تستجيب لكل التطورات الدولية الحاصلة، لأن المغالاة في الصياغة العامة ومرونة نصوص الفصل السابع على وجه التحديد، ترتب عليها إطلاق يد مجلس الأمن في كثير من المسائل أهمها نص المادة 39 من الميثاق. والتي لا تتضمن أية معايير موضوعية يستند عليها المجلس في وصفه للأفعال التي تشكل خطراً على السلم والأمن الدوليين. هذه السلطة التقديرية الكاملة التي يتمتع بها مجلس الأمن الدولي، أصبحت من أهم الأسباب التي تخرجه عن قواعد وأحكام الشرعية الدولية; حيت تلعب الاعتبارات السياسية وتغليب مصالح الدول الكبرى دورا بارزاً في صنع قراراته وفقا للتسوية الملزمة الصادرة عنه.
