المستخلص: La théorie des circonstances exceptionnelles de la plus grande fermeté les théories controversées doctrinale et juridique, car il comprend des mesures graves touchent directement aux droits et libertés fondamentaux des personnes, pour maintenir l'ordre public et pour que l'autorité publique représentés dans le pouvoir exécutif dans l'Etat de moyens légaux conduire à restriction et le resserrement de s'appuyer sur le principe de la légalité et minimaliste car elle ne peut pas répondre aux circonstances exceptionnelles sauf avec des décisions exceptionnelles.

تعتبر نظرية الظروف الاستثنائية من اشد النظريات إثارة للجدل الفقهي والقانوني لما تنطوي عليه من إجراءات خطيرة وجسيمة تملس مباشرة بالحقوق والحريات الأساسية للأفراد بهدف الحفاظ على النظام العام وفي سبيل ذلك تلجا السلطة العامة ممثلة في الجهاز التنفيذي في الدولة إلى وسائل قانونية تؤدي إلى التقييد والتضييق من الاعتماد على مبدأ الشرعية والعمل به في أضيق الحدود إذ انه لا يمكن مواجهة الظروف الاستثنائية إلا بقرارات استثنائية.

The theory of exceptional circumstances is considered to be one of the most controversial doctrinal and legal theories because it involves serious and dangerous actions that directly infringe on the fundamental rights and freedoms of individuals in the pretext of maintaining public order. Therefore, the public authority, represented by the executive branch of the State, resorts to legal means to restrict and limit reliance on the principle of legality and to its strictest application, since extraordinary circumstances can be met only by extraordinary decisions.
