المستخلص: يعتبر الضرر البيئي الناجم عن الاستخدامات العسكرية للمواد النووية، من أخطر الكوارث المحدقة بالإنسان والبيئة على الأرض، حيث تهتم هاته الدراسة بتسليط الضوء على مجموعة من المسائل غاية في الأهمية، إذ نستهل الموضوع بتعريف الاستعمال المدني والعسكري للطاقة النووية، تلك المادة الخطيرة جدا على صحة الشعوب وبيئتها، ثم نبين الاختلاف بين امتلاك الطاقة النووية السلمية الذي يعد حقا من حقوق الدول والشعوب وبين الاستعمال الغير سلمي الذي تمنعه اتفاقيات القانون الدولي لحقوق الانسان والقانون الدولي الإنساني، لنصل الى تبيان اهم الاسس القانونية الداعمة لحق الدول في الاستعمال السلمي والاخرى المانعة لذلك الاستعمال المقترن بالقوة وإلحاق أضرار نتيجة أعمال لا ضرورة لها.

Les dommages environnementaux causés par les utilisations militaires des matières nucléaires, des actes graves qui touchent l'homme et l'environnement sur le terre, cette étude examine une série de questions importantes: Tout d'abord, la définition d'un usage civil et de l'énergie nucléaire militaire, ainsi que pour montrer la différence entre posséder l'énergie nucléaire industrielle, qui est le droit de les Etats et les droits des peuples et entre l'utilisation non civile, ce qui empêche le droit international des conventions relatives aux droits de l'homme et du droit international humanitaire, et nous savons que des bases juridiques les plus importantes qui donnent aux États le droit à un usage civil et usage militaire, et la définition de la douleur responsabilité internationale.

Environmental damage caused by military uses of nuclear materials is considered one of the most serious disasters to humans and the environment on Earth. This study focuses on highlighting a number of very important issues, as we begin the topic by defining the civilian and military use of nuclear energy, that material very dangerous to the health of peoples and their environment. Then, we will point out the difference between the possession of peaceful nuclear energy, which is a right of States and peoples, and the non-peaceful use prohibited by international human rights and humanitarian law conventions. Let's find out the most important legal basis supporting the right of states to peaceful use and the other preventing such use in conjunction with force and causing damage as a result of unnecessary actions.
