المستخلص: يحاول الباحث دراسة أحكام القتال بين المسلمين، كظاهرة مركبة ومعقدة، ذات أسباب كثيرة ومتداخلة، تزعزع الأمن والسلام المجتمعي. وقد انطلق في هذه الدراسة من فرضية عامة مضمونها أن أشكاله المتنوعة في آثارها غير قابلة للفهم جميعها بنفس الطريقة أو بإرجاعها إلى نفس العوامل. ورأى، من جهة أخرى، أن الاستناد إلى المقاصد الشرعية من شأنه أن يساعد في فهم تلك الآثار، وذلك بإبراز أثر ذلك الاقتتال في حدوثه وتنوعه وعواقبه على الأمن المجتمعي. وهذا يدفعنا إلى وضع تصور صحيح مرتبط بواقع حياة المجتمع، وشكل العلاقات الحاكمة بين قواه وفئاته. وهدف البحث تحليل أسباب القتال داخل الدولة المسلمة وما يلحقه من عواقب وخيمة على أمن وسلامة المجتمع المسلم، مع تحديد المعالجات لبعض المشاكل التي أحاطت بعصرنا من منظور مقاصدي. وقد استخدم الباحث منهجية الاستقراء للمقاصد من النصوص، لاسيما في مجال القتال داخل الدولة المسلمة، وكذلك منهجية الوصف والتحليل في عرضها. وخلص الباحث في نهاية بحثه إلى أن المتتبع لمقاصد التشريع الإسلامي، يلحظ جليا أهمية مراعاتها لحفظ النظام في الدولة المسلمة، والذي من شأنه أن يسهم في تحقيق السلام الاجتماعي.

The researcher attempts to study the provisions of fighting among Muslims, as a complex and complicated phenomenon with many overlapping causes that destabilize security and social peace. This study is based on a general hypothesis that the different forms of fighting, in terms of their effects, cannot be understood in the same way or by referring them to the same factors. The study views, from a different perspective, that relying on the Shariah objectives (maqasid) shall help to understand those effects by highlighting the effect of that fighting in terms of its occurrence, variety, and consequences on the social peace. This propels us to formulate a correct conceptualization that is related to the reality of the life in the society, and the governing relationships among its forces and classes. The research aims to analyze the causes of fighting inside the Muslim state along with its severe consequences on the security and safety of the Muslim society, along with identifying the treatment of some of the problems that surrounded this age from the perspective of Shariah objectives (maqasid). The researcher utilizes the inductive methodology for surveying the objectives (maqasid) in the texts, particularly in the field of fighting inside the Muslim state, in addition to the descriptive and analytical approaches in presenting them. At the end of the research, the researcher finds out that, in terms of Islamic Shariah objectives (maqasid), the significance of considering the Shariah objectives (maqasid) is clearly noted so as to preserve stability and order in the Muslim state, which contributes to achieve the social peace.
