|a إن زيادة المستوى الحضاري في العالم، يقابله بالضرورة زيادة وتوسع في الحقوق محل الحماية، ولعل الجيل الثالث من حقوق الإنسان المتعلق بالتنمية، خير دليل على الحقوق المستجدة في الوقت الراهن، ويتصدر الحق في حماية البيئة طليعة الحقوق التي عرفت غزارة تشريعية غير مسبوقة إن على المستوى الداخلي أو الدولي، وتنوعت الحماية القانونية المقررة لحماية هذا الحق، بين دولية ودستورية، إدارة ومدنية، وحتى جزائية، حيث قدر المشرع الجزائري أن بعض صور المساس بالبيئة تعتبر من قبيل الجرائم المعاقب عليها، وقد حاولنا من خلال هذه الورقة البحثية تسليط الضوء على الأفعال الإجرامية الماسة بالبيئة والعقوبات المناسبة لها، من خلال ثلاثة محاور أساسية؛ تناولنا في الأول تعريف الجريمة البيئية ومختلف المشاكل المتعلقة بالإطار المفاهيمي، أما المحور الثاني فخصصناه إلى مشكلة تعدد النصوص الجزائية الناظمة للجرائم البيئية، لنقف في المحور الأخير على تقدير العقوبات المقررة للجرائم البيئية.

|b The increase in the level of civilization in the world is necessarily offset by the increase and expansion of rights under protection, and perhaps the third generation of human rights for development is evidence of the emerging rights at the present time. , and the right to protect the environment is at the forefront of the rights that have been known to have unprecedented legislative efficiency. The legal protection provided for the protection of this right has varied between internal and international, constitutional, administrative, civil and even punitive, the Algerian legislator estimated that some forms of harm to the environment are considered as punishable crimes, and we have tried through this paper to shed the light on the criminal acts harmful to the environment and appropriate penalties for them , We also discussed the definition of the environmental crime and the various problems related to the conceptual framework. The second axis was devoted to the problem of the multiplicity of criminal texts governing environmental crimes, finally, we address the assessment of the penalties for environmental crimes
