يعالج البحث مسألة فقهية بيئية مهمة والتي تتعلق بمياه الصرف الصحي الناتجة عن الأنشطة البشرية وما تسببه من التلوث البيئي. ويظهر أسبقية الدين الإسلامي للتشريعات الوضعية في وضع التشريعات المحكمة والقواعد الشرعية لحماية البيئة من آثار هذا التلوث. ومن أعظمها قاعدة الضرر يزال التي توجب إبعاد الضرر حتى لا يكون سببا في لحاق الأذى بمكونات البيئة. كما يبين شرعية عملية تنقية مياه الصرف الصحي وعدها خطوة إيجابية على طريق تحسين وحماية البيئة، وتوفير مصدر للمياه غير تقليدي يعود نفعه على الفرد والمجتمع. وهدف البحث هو إبراز أثر القاعدة الفقهية (الضرر يزال) في حماية البيئة من أضرار مياه الصرف الصحي، ونشر الفقه البيئي المتعلق بقضية تلوث المياه وأثرها البيئي، وبيان الحكم الشرعي في ذلك، وربط المسألة بالقواعد الفقهية، والمقاصد الشرعية. وقد اقتضت خطة الدراسة في هذا البحث تقسيمه إلى فصلين، وخاتمة، الأول في حماية البيئة من الأضرار الناجمة عن مياه الصرف الصحي، والثاني في تنقية مياه الصرف الصحي ضرورة شرعية. ومن أبرز النتائج والتوصيات التي توصلت إليها: أهمية قاعدة الضرر يزال في إرساء المفاهيم البيئية وضبط التصرفات بما يحقق المصلحة المتوازنة للفرد والجماعة، وإخراج مسألة التنقية كضرورة شرعية عامة، واستنادها في القول بها إلى المصلحة المرسلة، واعتبار المآل.
The research is dealing with an important environmental juristic matter which is related with sanitary waste water which is a result of human activities and what it is causing environmental pollution. Islam shows its priority for applied regulations and the development of legislation and legal rules to protect environment from the effect of pollution, and the greatest one is (Damage Terminated) which it's imperative to move away the damage to be not a reason in harmful With environmental components. It's also indicate the legacy of Sanitary Drainage Water & Sterilization process and told that it's a positive step on the way of improve and protect the environment , and saving unusual source of water and it benefits the person and society. The research goal is to indicate the effect of juristic rule (Damage Terminated) in environment protect from the damages of sanitary drainage waste water and to expand the environmental juristic which is related with water pollution and its effect on the environment ,and the declaration of Islamic ruling to reuse the sanitary drainage water after sterilization in all sides. The approach is followed the Inductive Method and which is general inductive in the subject of research, and the Descriptive Method in the process of sterilization to get to its nature, then the Theoretical Approach by mention of the Islamic legal evidences, then it is followed by Deductive Method to get to the declaration of Islamic Law to use this kind of water after being sterilized, then being applied to Rules of Jurisprudence and juristically purposes. The study plan has been required in this research to be divided into a presentation in environmental protection under the juristically purposes, and three chapters, chapter one is in environmental protection and the damages caused by sanitary, and chapter two is in (Sanitary Drainage Water & Sterilization is a legitimacy necessity); and the third chapter is about the followed methods in the sterilization of Sanitary Drainage water and the rule of its usage after being sterilized. From the most prominent results and recommendation which I got is: The importance of the rule of damage and embed the terms of environment and regulate the behavior which attains to the balanced weal of the individual and the society; and to be realized that the sterilization matter is a general legitimacy necessity , and for absolute benefit and consider funds and it's to be permissible to use the Sanitary Drainage Water after advanced Triple Sterilization in all sides, and it's also to be permissible to use Bilateral Sterilization in plants irrigation, detergents, tanning, and construction process.
