المستخلص: The right to express an opinion is one of the rights inherent to the human being and one of the most prominent forms of this right (peaceful demonstrations and gatherings). Freedom of demonstration and peaceful assembly is of great importance to the lives of citizens, as it is the means by which individuals express their views and desire for reform in various aspects of life. The right to demonstrate and to peaceful assembly is no less important than the right to vote if the right to vote is a means of peaceful circulation of power. On the other hand, the right to demonstrate and peaceful assembly is an effective means of confronting the authority and informing it of the needs of citizens. It is also a means of pressure exerted by peoples to push governments to do what the people want, as every citizen looks forward to seeing his rights protected in his country, but at the same time the exercise of this freedom must be carried out without provoking any disturbance or chaos that threatens the security and public order of society.

يعد حق التعبير عن الرأي من الحقوق اللصيقة بالإنسان ومن أبرز صور هذا الحق (التظاهر والتجمعات السلمية). ولحرية التظاهر والاجتماع السلمي أهمية بالغة في حياة المواطنين إذ أنها الوسيلة التي يعبر بها الأفراد عن آرائهم ورغبتهم في الإصلاح في مختلف جوانب الحياة، ولا يقل حق التظاهر والاجتماع السلمي أهمية عن حق الانتخاب، فإذا كان حق الانتخاب يعد وسيلة للتداول السلمي للسلطة. فإن حق التظاهر والاجتماع السلمي يعد من جانب آخر وسيلة فعالة في مواجهة السلطة وإعلامها بحاجات المواطنين، كما انه بمثل وسيلة ضغط تمارسها الشعوب لدفع الحكومات للعمل بما يريده الشعب إذ أن كل مواطن يتطلع إلى أن يرى حقوقه مصانه في وطنه، ولكن في الوقت ذاته يجب أن تتم ممارسة هذه الحرية بعيدا عن إثارة أي اضطرابات أو فوضى تهدد الأمن والنظام العام في المجتمع.
