المستخلص: Before entering the study, it is worth noting that the State Consultative Council is the old name of the Iraqi State Council, which was mentioned in Article (101) of the Constitution of the year 2005, which states: "A Council of State may be established by law to deal with the functions of administrative judiciary, The State, and all other public bodies, before the courts, except what is excluded by law, Twelve years later, the State Council Law No. (71) Of 2017 promulgated, including eight articles. Article (1) stipulates that” The Council of State is concerned with the functions of administrative justice; an independent body with a moral personality shall be represented by the President of the Council. It shall chose by the Presidency of the Council to be among the advisers appointed by law. Article 2 of the Law stipulates that ’’The provisions of the Law of the State Consultative Council No. 65 of 1979 shall apply to The Council of State provided for in Article 1 of this Law shall be replaced by the name of the Council of State (the State Consultative Council) wherever it is mentioned in the legislations. The first two matters were the disqualification of the executive branch represented by the Ministry of Justice, , While p (1) of Article (3) of the Constitution stipulates that ’’the obligations and rights of the State Consultative Council shall be transferred to the Council of State established under this Law and shall be transferred to the Council of State by its courts, administration, Therefore, all of the above remains the same without any change except in the name and disconnection with the Ministry of Justice. We have committed ourselves to this law and passed through the same name mentioned in the above law. The Iraqi Council of State consists of a number of bodies and a number of courts. The bodies are the General Assembly, the expanded body and the specialized bodies. It has three courts: the Administrative and Administrative Courts and the Supreme Administrative Court. Each has its own function and represents the jurisdiction of the State Council. , Which exercises two other competencies, namely, competence in the field of advisory opinion and in the area of legislation

قبل الدخول بالدراسة من الجدير الإشارة إلى أن مجلس شورى الدولة هو الاسم القديم لمجلس الدولة العراقي والذي ذكره دستور سنة (2005) بالمادة (١٠١) حيث نص على أنه "يجوز بقانون. إنشاء مجلس دولة يختص بوظائف القضاء الإداري، والإفتاء، والصياغة. وتمثيل الدولة، وسائر الهيئات العامة، أمام جهات القضاء إلا ما استثني منها بقانون" وبعد اثنى عشر عاما صدر قانون مجلس الدولة رقم (٧١) لسنة (٢٠١٧) متضمنا ثمان مواد ونص في مادته رقم (١) على أن ينشأ بموجب هذا القانون مجلس دولة يختص بوظائف القضاء الإداري والإفتاء والصياغة، ويعد هيئه مستقلة تتمتع بالشخصية المعنوية يمثلها رئيس المجلس ويتم اختياره من قبل رئاسة المجلس على أن يكون من بين المستشارين فيه ويعين وفقا للقانون" ونصت المادة (٢) منة على أن "تسري أحكام قانون مجلس شورى الدولة رقم (65) لسنة (١٩٧٩) على مجلس الدولة المنصوص عليه في المادة (١) من هذا القانون. وتحل تسمية (مجلس الدولة) محل (مجلس شورى الدولة) أينما وردت في التشريعات "وقد جاء بأمرين مهمين الأول فك ارتباطه بالسلطة التنفيذية ممثلة بوزارة العدل، والثاني جعله قضاء مستقلا يتمتع الشخصية المعنوية، أما عن أعضائه وتشكيلاته واختصاصاته فهي ذاتها التي كانت في مجلس شورى الدولة فقد نصت الفقرة (أولا) من المادة (٣) منه على أن "تنقل التزامان وحقوق مجلس شورى الدولة إلى مجلس الدولة المؤسس بموجب هذا القانون وتنقل محاكمه وإدارته ومنتسبيه وأمواله إلى مجلس الدولة "وعلى هذا كل ما تقدم يبقى على ما هو عليه من دون تغيير سوى في الاسم وانفكاك ارتباطه بوزارة العدل وقد التزمنا بهذا القانون وعبرنا بذات الاسم الوارد في القانون أعلاه يتكون مجلس الدولة العراقي من عدد من الهيئات وعدد من المحاكم، أما الهيئات فهي الهيئة العامة والهيئة الموسعة والهيئات المتخصصة وله ثلاثة محاكم هي محكمه قضاء الموظفين والمحاكم الإدارية بالإضافة إلى المحكمة الإدارية العليا، ولكل منها وظيفة تختص بأدائها كما أنها تمثل بمجموعها الاختصاص القضائي لمجلس الدولة، والذي يمارس اختصاصين آخرين هما اختصاصه في مجال الإفتاء وفي مجال التشريع
