520 |a القرار الإداري الضمني بوصفه أحد أنواع القرارات الإدارية من حيث الشكل يتمتع بطبيعة خاصة، لكون الإدارة تلتزم السكوت اتجاه الطلبات المقدمة إليها مدة من الزمن يحددها القانون يترتب عليها قرار ضمني بالرفض أو القبول، ومن الممكن أن يكون هذا القرار معيب بعيب من عيوب المشروعية، لذا من الطبيعي أن تكون هناك وسائل حماية للأفراد اتجاه القرار الضمني غير المشروع، وتتمثل هذه الوسائل بالوسائل القانونية المقررة بموجب نص قانوني والوسائل الإدارية التي تمارسها الإدارة من أجل تصحيح الأخطاء التي وقعت بها عند إصدار القرار الضمني. ولأهمية هذه الوسائل في حماية حقوق الموظف فقد اخترناها موضوعا لبحثنا.
