|a إدا كانت الخبرة القضائية وسيلة يلجأ إليها القاضي في القضايا ذات الطابع الفني والعلمي الذي يخرج عن حدود معرفته وإدراكه والتي يتطلب حلها إجراء خبرة فنية، فانه ينبغي عليه عدم الإسراف في الاستعانة بهذا الإجراء بدون مبرر أو ضرورة ملحة، وبعبارة أخرى ينبغي أن لا تتحول الخبرة القضائية إلى وسيلة للقاضي يلقي بها مهمته على غيره وإلا كان ذلك تفويضا منه لسلطته القضائية.\nلذلك يجب أن يكون قرار الاستعانة بالخبراء مسببا وضروريا حتى لا ينتج عن ذلك إطالة أمد التقاضي وإهدار الجهد وزيادة التكاليف.

|f Judicial expertise is a means to be used by the judge in cases of a technical and scientific nature that goes beyond the limits of his knowledge and awareness and whose resolution requires the conduct of technical expertise; he should not overuse such a procedure without justification or urgency. In other words, judicial expertise should not be transformed into a means for a judge to lay down his or her mission on others; otherwise, it would be the delegation of his judicial power. \nTherefore, the decision to hire experts must be reasoned and necessary so as not to prolong litigation, waste of effort, and increased costs.\nThis abstract translated by Dar AlMandumah Inc. 2021
