|a تعتبر قضايا الأجرة والأجير من بين المسائل التي أشارت إليها كتب النوازل، حيث زودتنا هذه الأخيرة بمعلومات في غاية الأهمية عن واقع الأجير وعلاقته بالمستأجر، ومن خلال ما جاء فيها من معلومات يعالج هذا البحث إشكالية استئجار راعي الماشية في أرياف المغرب الأوسط في العصر الوسيط على اعتبار أنه يمثل أنموذج الأجراء في المجتمع الريفي وقتها، وسيكشف لنا عن أشكال اتخاذ الراعي للماشية ونوع الأجرة المستعملة، ويوضح حدود مسؤولية الراعي على ما يرعاه، ويفسر الخلافات التي كانت تظهر بين صاحب الماشية والراعي وكيفية حلها، ومدى خضوع أطراف النزاع إلى حكم القاضي أو الفقيه المعتمد على الضابط الشرعي أو العرفي
