المستخلص: The Ministry of Education is the administrative body responsible for the organization of general examinations and is responsible for the duty to maintain the general system of examinations for its administrative control authorities. To achieve this end, the administration shall use all material and legal means as required by laws and regulations. However, this does not absolve itself of its legal liability whenever any material or moral damage caused to individuals by an error or without error, or may result in disruption of public order. The general examinations (Baccalaureate examinations) in Iraq are of great importance, particularly in the preparatory stage of the sixth Grade. The results of the examinations are determined by determining the future direction of the student to complete his / her studies in this or that college. The system of public examinations suffers from many legislative and regulatory problems. The legislative side is unable to absorb the requirements of the current stage, in terms of providing legal protection for examinations and their results, as well as determining the rules of responsibility required in case of proven error or failure, whether by the administration or the student. Hence the problem of our research, which we will study through adopting the comparative analytical approach with the Arab Republic of Egypt since it gets closer a little bit to the educational system in Iraq and its adoption of the system of general examinations, especially within the third grade of the stage of comprehensive secondary education and corresponds to the stage of the sixth preparatory stage in Iraq. However, this will not prevent the reference to other countries if this is required in the subject of the research. At the conclusion of this study.
