المستخلص: الإفتاء من أجل الأعمال، وأعظم المهام في الدين الإسلامي، وهو من فروض الكفايات، لأنه لا غنى للأمة الإسلامية عنه في وقت من الأوقات، ولا يجوز أن يتصدى له إلا من توفرت فيه شروطه، وكمل فيه صفات المبلغ عن الله- تعالى- من التقوى والورع والعلم وغيرها، لأن المفتي قائم مقام النبي- صلى الله عليه وسلم- في تعليم الناس أمور دينهم، وبيان الحلال والحرام من أقوالهم وأفعالهم، وهذا مستلزم لجملة شروط يجب توفرها لمن يتصدى للفتيا. وأسفرت دراسة هذا الموضوع عن جملة من النتائج أهمها تغير الفتوى معناه: العدول بالمسألة عن حكم تكليفي إلى حكم آخر لموجب شرعي اقتضى هذا العدول، وهذا الموجب الشرعي قد يكون، تغير الزمان، أو المكان، أو العرف، أو المال، أو العلة، أو الحال، أو الشخص، أو نحوها، ولا يقبل تغير الفتوى إلا من فقيه ثقة، واسع في فهم الشريعة فروعا وأصولا، تحقيقا وتدقيقا، له معرفة تامة بواقع المسألة التي استفتى فيها، وملابساتها، وأحوالها، وأبعادها، وحيثيتها.

Issuing fatwa is the greatest work and task in the Islamic religion. It is Fard al-Kifaya (that is obligatory for the Muslim community collectively) because Muslim Ummah can not remain indispensable from it at any time. Only those who meet certain conditions should respond and deal in Issuing Fatwas. They should be characterized by the qualities of the preacher of the religion of Allah, such as piety, godfearing, knowledge, etc. Since Mufti holds the place of the Prophet (peace and blessings of Allaah be upon him) in teaching people about the matters of their religion and explaining the halal (permissible) and haraam (forbidden) in their words and deeds, this requires a range of conditions that must be met for those who issue the fatwas. The study of this topic led to a number of results, the most important of which is the change in the meaning of the Fatwa: changing the assigned ruling in a matter to another ruling for a legitimate reason that required this change, and this legitimate reason may be, change in time, place, custom, money, or illness, or situation, or the person, and like that. The change of Fatwa is accepted only from a trustful jurist, who has a broad understanding of the principles and branches of Shariah in terms of researching and scrutinizing. He must have the full knowledge of the reality, circumstances, conditions, dimensions, and relevance of the matter, in which he has been requested to guide.
