|a يمثل الثبات التشريعي حجز زاوية في الاستثمار الأجنبي، حيث جاء هذا البحث لدراسة هذا المبدأ وجدلية التعارض بين التجسيد للأمان القانوني للمستثمر من جهة وبين مصلحة الدولة في تعديل تشريعاتها بما يضمن مصلحتها تجاه الغير، حيث جاء هذا لبحث مبحث تمهيدي تضمن مفهوم شرط الثبات التشريعي ومضمونه في التشريع الأردني ومبحث الأول وهو أنواع شرط الثبات التشريعي والتكييف القانوني له والمبحث الثاني شرط الثبات التشريعي للقانون بين تكريسه للأمان القانوني وتقييده لسلطة الدولة.\nوتم اعتمدت على المنهج الوصفي والتحليلي وذلك للوصول إلى نتائج تفيد الإجابة عن أسئلة الدراسة ولقد توصل الباحث إلى مجموعة من النتائج أهمها ضرورة أن يورد المشرع الأردني اللجوء للتعويض في حالة مخالفة شرط الثبات التشريعي ولم ينص كذلك على أسس تقديره، أن يورد المشرع نصاً يوازن بين حق الدولة في التشريع وبين حق المستثمر في استقرار التشريعات أو الحصول على تعويض في حال تعديل التشريع المتعلق بالعقد.\n

|f Legislative stability represents the cornerstone in foreign investment. This research came to study this principle and the dialectical contradiction between the embodiment of the legal security of the investor on the one hand and the interest of the state in amending its legislation to ensure its interest towards others. This came to research an introductory study that included the concept of the legislative stability condition and its content in the Jordanian legislation. The first chapter is about the types of the legislative stability condition and its legal adaptation. The second chapter is about the legislative stability condition of the law between its dedication to legal security and its restriction to the authority of the state.\nIt relied on the descriptive and analytical approach to reach results that answer the questions of the study. The researcher reached a set of results, the most important of which is the need for the Jordanian legislator to include the resort to compensation in the event of a violation of the legislative stability condition and did not stipulate the bases of his assessment as well, that the legislator provides a text that balances the right of the state in legislation and the investor's right to the stability of legislation or to obtain compensation in the event of amending the legislation related to the contract.\nThis abstract translated by Dar AlMandumah Inc. 2021
