يهدف هذا المقال إلى دراسة الأمانة العلمية بين أخلاقيات الباحث وتفعيل الحماية القانونية من خلال دراسة المعايير السلوكية والأخلاقية للبحث العلمي في ضوء الأمانة العلمية، وما تنطوي عليه من شبكة معقدة من المحددات والنتائج السلبية التي تعود على الباحث وعلى البحث العلمي في حالة انعدام هذه الأمانة العلمية، حيث أصبحت من المشاكل الرئيسية، التي تدعو للقلق في عدد متزايد من البلدان نتيجة لتفاقم آثارها وتسارع وتيرتها بشكل كبير، ما يستدعي دراستها وتحليلها بشكل علمي، حتى نتمكن من معرفة أسبابها وسبل معالجتها بطريقة علمية، حتى نتوصل إلى معرفة الآليات القانونية لمكافحتها، بحيث نجد اهتمام عالمي بالقيم والضوابط في مجالات البحوث المختلفة، وهذا الاهتمام العالي يرجع إلى أسباب منها: اتساع رقعة البحث العلمي وتناوله لمجالات لم يسبق للعلم أن طرقها، دولية البحث العلمي، البحث العلمي لم يعد مجالا فرديا بل استثمار كما أن دخول العنصر التجاري في مجال البحث العلمي، ويتطلب البحث العلمي في التربية وفي المجالات الأخرى توافر مجموعة من القيم والمبادئ الأخلاقية في من يمارسه، ويخطئ من يتصور أن العملية البحثية لا تعدو مجرد فهم مجموعة من الأسس والإجراءات التي تتصل بتحديد المشكلة وإعداد التصميم البحثي وتجميع البيانات والتعامل الإحصائي مع تلك البيانات وكتابة تقارير البحث، وإنما هناك مجموعة من المعايير السلوكية والأخلاقية، التي تصاحب كل مرحلة من تلك المراحل، وعلى الباحث أن يكون ملما بتلك المعايير، ذلك أنه يتعامل مع بشر لهم حقوقهم ولهم كرامتهم؛ التي يجب الحفاظ عليها وصيانتها من كل ضرر ظاهر أو محتمل Cette intervention vise à étudier le secrétariat scientifique, entre l'éthique du chercheur, et l'activation de la protection juridique à travers l'étude des normes de comportemen,t et de la recherche scientifique et éthique à la lumière de l'honnêteté scientifique, et ce qu'il implique un réseau complexe de déterminants et des résultats négatifs datant du chercheur, et de la recherche scientifique dans le cas de ce manque d'honnêteté scientifique, où il est devenu l'un des principaux problèmes, qui appelle de préoccupation dans un nombre croissant de pays en raison des effets aggravants et le rythme accéléré de façon spectaculaire, ce qui nécessite une étude et une analyse d'une manière scientifique, afin que nous puissions connaître leurs causes et les moyens de les traiter d'une manière scientifique, de sorte que nous parvenions à Connaissance de contrôle juridique, de sorte que l'on trouve des valeurs d'intérêt mondiaux et des contrôles dans les différents domaines de la recherche, et cette attention mondiale en raison des raisons, notamment: l'expansion de la recherche scientifique et de manger n'a jamais appris que les méthodes, la recherche scientifique internationale, la recherche scientifique est plus une zone individuellement, mais les zones que l'élément d'entrée le commerce dans le domaine de la recherche scientifique, nécessite la recherche scientifique dans l'éducation et dans d'autres domaines, la disponibilité d'un ensemble de valeurs et de principes éthiques dans ceux qui la pratiquent, et misses imaginer que le processus de recherche est rien de plus que la simple compréhension d'une série de fondations et procédures relatives à l'identification du problème et la préparation de la conception de la recherche Ot Toutes les données et le traitement statistique de ces données et rédiger des rapports de recherche, mais il y a un ensemble de normes comportementales et éthiques qui accompagnent chaque étape de ces étapes. This article aims to study the scientific honesty between the ethics of the researcher and the activation of legal protection by studying the behavioral and ethical standards of scientific research in light of the scientific honesty and its complex network of determinants and negative consequences for the researcher and scientific research in the absence of such scientific honesty. It has become one of the major problems of concern in an increasing number of countries as a result of their increased and significantly accelerated effects, requiring scientific study and analysis, so that we can find out the causes and ways to treat them scientifically and understand the legal mechanisms to combat them. We find global interest in values and disciplines in different areas of research. And this high interest is due to the following reasons: The expansion of scientific research and its treatment of areas that have never been known to science; globalization of scientific research; scientific research is no longer an individual field but an investment; the entry of the commercial component in the field of scientific research. Scientific research in education and other fields requires a set of ethical values and principles in the researchers. The one who perceives that the research process is merely understanding a set of foundations and procedures that relate to problem identification, preparation of research design, collecting data, statistical handling of those data, and writing research reports, is mistaken. Rather, there is a set of behavioral and ethical standards that accompany each of these stages. The researcher must be familiar with these standards, as he deals with human beings who have their rights and dignity, which must be preserved and maintained from any apparent or potential harm.
