المستخلص: شكلّت جائحة covid-19 تهديدا حقيقيا على استقرار العلاقات التعاقدية المرتبطة بكرة القدم الاحترافية، فأمام عجز الأندية عن توفير العمل بسبب توقيف الدوريات الرياضية بقرارات حكومية للحد من انتشار الوباء، وأمام توقّف اللاعبين عن ممارسة الأنشطة الرياضية بسبب غياب العمل، ظهرت خلافات بين اللاعبين والأندية المحترفة مرتبطة بتخفيض الأجور بسبب الآثار المالية لهذه الجائحة، خاصة وأن لوائح FIFA لا تتوفر على نصوص تنظيمية لمثله هذه الوضعيات.
لكن ورغم تدخّل FIFA وحسمه في موضوع اعتبار جائحة فيروس كورونا المستجد قوة قاهرة، فان شروط تطبيق هذه النظرية من الناحية القانونية لا يمكن أن تستغرق جميع النزاعات الرياضية التي قد تثار مستقبلا، خاصة وأن تنفيذ أغلب العقود الرياضية ليس مستحيلا، بل هناك اتفاق على استمرارها شريطة تعديلها إلى الحد الذي يجعل تنفيذها مقبولا، وهنا سنكون أمام أحكام حالة الظروف الطارئة وليس القوة القاهرة.


La pandémie de Covid-19 a constitué une menace réelle pour la stabilité des relations contractuelles associées au football professionnel. Face à l'incapacité des clubs à fournir du travail en raison de la suspension des ligues sportives par des décisions gouvernementales visant à limiter la propagation de l'épidémie, et face aux joueurs cessant d'exercer des activités sportives en raison de l'absence de travail, des différences sont apparues entre les joueurs et les clubs professionnels Lié aux baisses de salaires dues aux implications financières de cette pandémie, d'autant plus que les règlements de la FIFA ne disposent pas de textes réglementaires pour de tels cas.

The covid-19 pandemic posed a real threat to the stability of contractual relations related to professional football. In the face of club's inability to provide work due to the suspension of sports leagues by government decisions to limit the spread of the epidemic, and in the face of players' discontinuation to practice sport activities due to the absence of work, differences emerged between players and professional clubs regarding wage cuts due to the financial implications of this pandemic, especially since FIFA's regulations do not have any regulatory texts for such situations.
However, despite FIFA's intervention and determination in considering the emerging Coronavirus pandemic a force majeure, applying this theory from a legal standpoint cannot take all sports disputes that may arise in the future. Especially since the implementation of most sports contracts is not impossible, there is an agreement to continue it provided that amending them to the extent that makes their implementation acceptable. Here we will be faced with the provisions of a state of emergency, not force majeure.
