|a إن النزاع في التنفيذ هو عارض قانوني وليس مادي يعترض تنفيذ الحكم الجزائي، أي يتعلق بالقوة التنفيذية للحكم وبعبارة أخرى نزاع قضائي يتعلق بشرعية التنفيذ، وهو دعوى عمومية تكميلية تهدف إلى صيانة وضمان حرية وحقوق المنفذ عليه وكذا ضمان عدم التعسف، والنزاع في التنفيذ يختلف عن دعوى التفسير ودعوى تصحيح الخطأ المادي، ولابد أن يبنى على أسباب قانونية منها ما يتعلق بالحكم محل التنفيذ ومنها ما يتعلق بالمنفذ عليه ومنها ما يتعلق بما يتطابق مع القانون.
