المستخلص: يتناول هذا البحث قضية الحوكمة وأثرها في تطوير المؤسسات الوقفية المعاصرة، فقد تزايدت مطالبات المحاسبة والحوكمة على المؤسسات الوقفية، بما يكفل الشفافية، والإفصاح، والمساءلة، وتحديد المسؤولية، بما يسهم في حفظ الوقف، وأصوله، وممتلكاته. وتستمد هذه الدراسة أهميتها من تزايد الاهتمام بموضوع حوكمة الوقف، ودوره في زيادة فاعلية المؤسسة الوقفية، وحفظ حقوق كل من الواقفين، والموقوف عليهم، وتعزيز ثقة المجتمع في الوقف، عن طريق الإفصاح، والشفافية. وتهدف هذه الدراسة إلى وضع إطار عام لمفهوم حوكمة الوقف، من خلال بيان ماهية حوكمة الوقف، وفلسفتها، والباعث عليها، وتاريخها، ومعوقاتها. فضلا عن بيان أثر الحوكمة في تطوير مؤسسة الوقف، وتعزيزها، ونموها، وتطويرها. وقد توصلت الدراسة إلى أن نجاح مبادئ الحوكمة في تحقيق أهدافها لا يقف فقط عند إصدارها، وإنما يعتمد على جدية التطبيق، ونفاذ آثارها، كما أوصت الدراسة بضرورة التأكيد على أن المعرفة النظرية بأدبيات الحوكمة في المؤسسات الوقفية، والإلمام بمعاييرها ومبادئها النظرية لا تكفي لكي تتطلع الحوكمة بالدور المأمول منها، بل لا بد من: جهود متواصلة في التدريب عليها، والتوعية بقواعدها، وفوائدها المرجوة، والاحتكام إلى مبادئها، تطبيقا لا تنظيرا، والتطبيق الحازم، والتدقيق المستنير على إعمال معاييرها.

This research deals with the issue of governance and its impact on the development of contemporary endowment institutions, as demands for accountability and governance have increased over the endowment institutions, in a manner that guarantees transparency, disclosure, accountability, and limitation of responsibility, in a way that contributes to preserving the endowment, its assets, and its properties. This study derives its importance from the increased interest in the subject of endowment governance, and its role in increasing the effectiveness of the endowment institution, preserving the rights of both endowments and those arrested, and enhancing community confidence in the endowment, through disclosure and transparency. This study aims to set a general framework for the concept of endowment governance, by explaining what is endowment governance, its philosophy, motivator, history, and obstacles. As well as showing the impact of governance on the development, strengthening, growth and development of the endowment institution. The study found that the success of the principles of governance in achieving its goals is not only limited when they are issued, but rather depends on the seriousness of application and the enforcement of its effects, the study also recommended the need to emphasize that theoretical knowledge of the governance literature in endowment institutions, and familiarity with the standards and theoretical principles are not sufficient for governance to play the role What is expected of them is, rather, it is necessary: continuous efforts in training on them, raising awareness of their rules, their desired benefits, and invoking their principles, unparalleled application, firm application, and informed scrutiny to implement their standards.
