المستخلص: سنحاول من خلال هذه الدراسة البحث في مدى إمكانية تكييف المبادئ العامة التي تحكم اتفاق التحكيم مع الأسس العامة التي تقوم عليها العقود الإدارية، والتي من أهمها وجود شخص معنوي عام يهدف إلى تحقيق مصلحة عامة كطرف فيها، كما سنسعى للكشف عن المزايا التي يمكن أن يستفيد منها هذا الأخير عند اختياره إبرام اتفاق التحكيم لحل منازعات عقوده الإدارية بدلا من رفع دعوى بشأنها أمام القضاء الإداري.

Nous allons essayer à travers cette étude, déterminer la possibilité d'adapter les principes généraux qui régissent la convention d'arbitrage avec les fondements qui caractérisent les contrats administratifs, notamment l'existence d'une personne publique qui poursuivant un but d'intérêt général, et nous allons détecter les avantages qui pourraient bénéficier ce dernier lorsqu'il choisit l’arbitrage pour régler les contentieux de ses contrats administratifs au lieu de déposer une requête devant le juge administratif.

Through this study, we will try to examine the extent to which the general principles governing an arbitration agreement can be adapted to the general grounds on which administrative contracts are based, the most important of which is the presence of a public legal person aimed at achieving a public interest as a party to them. We will also seek to reveal the advantages that the latter can benefit from when choosing to conclude an arbitration agreement to resolve disputes of his administrative contracts rather than filing a claim before the administrative courts.
