المستخلص: The abolition of restrictions on real estate transactions for Individuals. The political and economic reforms in Algeria following the issuance of the 1989 Constitution under which it shifted from a system glorifying collective real property to another one extolling and protecting the individual property; herefore the Algerian legislator sought to encourage Investment and attempted to attract capital so that the State had to cancel licenses For foreigners to encourage them to invest as well as the cancellation of licenses for Nationalists to create a broader dynamic for the real estate market and to liberalize more the real estate transactions, where licenses were canceled for both nationals or foreigners, the Pre-emption of state scheduled to real estate transactions for foreigners also was canceled as well as for the maximum ownership for both for agricultural or urban lands.

إن الإصلاحات السياسية والاقتصادية التي شهدتها الجزائر إثر صدور دستور 1989 التي تحول بموجبها من نظام يمجد الملكية العقارية الجماعية إلى نظام يمجد الملكية الفردية ويحميها ولذلك سعى المشرع الجزائري نحوي تشجيع الاستثمار ومحاولة منه استقطاب رؤوس الأموال وجب على الدولة إلغاء الرخص بالنسبة للأجانب لتشجيعهم على الاستثمار وكذلك إلغاء الرخص بالنسبة للوطنيين لإيجاد حركية أوسع بالنسبة للسوق العقارية وتحرير أكثر للمعاملات العقارية حيث ألغيت الرخص سواء بالنسبة للوطنيين أو الأجانب ألغيت أيضا الشفعة المقررة للدولة على المعاملات العقارية للأجانب وألغي أيضا الحد الأقصى للتملك سواء بالنسبة للأراضي الفلاحية أو العمرانية.
