المستخلص: It is known that Shari‘ah is distinguished by its keen concern for the rights of the leader and the people under him, and its fulfillment of the interests of the people and prevention of evils for them, this is entrenched through stipulating the rights and duties of both the leader and those under him. Also, [it is known] that the Shari‘ah is inherently a moderate law, based on development and construction, and that it contains general injunctions that regulate lives of the people and guarantee their security and safety, and safeguard their essentials (darūriyyāt), requirements (hājiyyāt) and embellishments (tahsīniyyāt). It also established a way for them to pledge allegiance (al-bay‘ah) [for their rulers], in order to preserve a decent life for people in which they will be free to observe their religious rites and their acts of worship and other acts that shall combine the benefits of this world and the hereafter for the servants of Allaah. And the essential elements in achieving these interests (al-masālih) is realizing the Shari‘ah objectives regarding the rights of the leader and those under him; and this is the objective of this research. Our devotion is for Allaah and upon His is our reliance.

معلوم أن الشريعة الإسلامية قد تميزت برعايتها لحقوق الراعي والرعية، وتحقيقها لمصالح الخلق ودفع المفاسد عنهم، وذلك بالنص على حقوق وواجبات كل من الراعي والرعية، وأن الشريعة الإسلامية شريعة وسطية واعتدال، وبناء وتعمير، وأن فيها أحكاما عامة تضبط حياة الناس وتحقق لهم الأمن والأمان، وتحافظ على الضروريات والحاجيات والتحسينات لهم، كما أنها رسمت لهم طريقة البيعة بما يحفظ للناس حياة كريمة يمارسون فيها شعائرهم وعباداتهم، وغير ذلك مما يجمع للعباد بين مصالح الدارين الدنيا والآخرة، ومما يسهم في تحقيق هذه المصالح معرفة المقاصد الشرعية لحقوق الراعي والرعية؛ وهو مقصود هذا البحث، والله من وراء القصد وعليه التكلان.
