المستخلص: The H. H. Abdulwahab manuscript 18067 is listed in the BNT’s catalog under the title: waṯāiqs Ibn Harūn. This is what we can infer from a paragraph, written in red ink, on folio 1r°. This had misled H. H. Abdulwahab, and those who have established the catalog, to assign unreservedly the text to Ibn Harūn, a Tunisian faqîh of the Hafsid era who died during the Black Death in 750 H / 1349 AD. In reality, as one goes through the reading of the text one quickly realizes that it is later. We can say that these waṯāiqs are exploitable in more than one way, namely the practice of law in the Muslim city, the property and its forms of transmission and especially the existence of a category of agents serving the cadi and the judicial system: these are the judicial experts.

Le manuscrit 18067 du fonds H. H. Abdulwahab est répertorié à la BNT sous l’intitulé: waṯāʾiqs Ibn Harūn. C’est ce qu’on peut retenir d’un paragraphe, écrit à l’encre rouge, sur le folio 1 r°. Ceci avait induit en erreur, H. H. Abdulwahab, et ceux qui avaient établi le catalogue attribuant sans aucune réserve le texte à Ibn Harūn, un faqih tunisois de l’époque hafside décédé lors de la peste noire en 750 H/1349 J.-C. En réalité, au fur et à mesure qu’on avance dans la lecture du texte on s’aperçoit vite qu’il est tardif. On peut dire que ces waṯāʾiqs sont exploitables à plus d’un titre, à savoir la pratique du droit dans la ville musulmane, la propriété et ses formes de transmission, et surtout l’existence d’une catégorie d’agents servant le cadi et l’appareil judiciaire: ce sont les experts judiciaires.
