المستخلص: This research aims to find out the fact of humanitarian security in Palestinian legislations, to explain Its relationship to development, and to identify ways of developing the relationship between the development and the Palestinian legislations, in a manner that preserves the dignity of the Palestinian people and achieves its well-being. The research discusses the relationship between the development and the human security, as a human right, explains the human security and democracy as a base of development and as a result of it. then it deals with joining the Palestinian National Authority to International Covenants, and obligations that consequences. It elucidates the relative violations and threats of the Palestinian Authority towards the human security of its citizens. It discusses the role of the Legislative Council in protecting human security and achieving sustainable development. Finally, it finds out the role of civil society organizations in monitoring the implementation of human security legislation in the Palestinian Authority territories. The research concludes with several results such as: the development cannot be achieved except by stability and the application of human security legislations. The Palestinian Authority must modify its legislations and policies related to human security in accordance with international agreements. Politicians and influential figures in the Palestinian Authority violate and threaten human rights, at the time they had to resist the violations of the Israeli occupation. Ultimately, the Palestinian Legislative Council did not take part, neither in protecting human security and in achieving sustainable development, nor in monitoring the Palestinian Authorities with its three powers: legislative, executive and judicial authority, despite the Authority's involvement in violating human security legislation in Palestine.

تهدف الدراسة إلى التعرف على واقع الأمن الإنساني في التشريعات الفلسطينية، وإلى بيان علاقته بالتنمية، وتحديد سبل تطوير العلاقة بين الأمرين بما يحفظ كرامة الإنسان الفلسطيني ويحقق رفاهيته. وتعرض الدراسة علاقة التنمية بالأمن الإنساني، باعتبارها حق من حقوق الإنسان، وأن الأمن الإنساني والديمقراطية قاعدة مؤسسة للتنمية ونتيجة لها، ثم تتناول انضمام السلطة الوطنية الفلسطينية إلى العهدين الدوليين؛ وما ترتب على ذلك من التزامات. وتتبع ذلك ببيان مدى ما وقعت فيه السلطة الفلسطينية من انتهاكات ومهددات الأمن الإنساني لمواطنيها، ثم تناقش دور المجلس التشريعي في حماية الأمن الإنساني وتحقيق التنمية المستدامة. وأخيرا تعرض لدور منظمات المجتمع المدني في الرقابة على تطبيق تشريعات الأمن الإنساني في أراضي السلطة الفلسطينية. وتوصلت الدراسة إلى عدة نتائج، منها: أنه لا يمكن تحقيق التنمية إلا بالاستقرار وتطبيق تشريعات الأمن الإنساني. وأنه يتعين على السلطة الفلسطينية أن تعدل تشريعاتها وسياساتها المتعلقة بالأمن الإنساني وفقا للاتفاقيات الدولية. وأن سياسيين وشخصيات متنفذة في السلطة الفلسطينية تنتهك حقوق الإنسان وتهددها، في الوقت الذي كان عليها أن تتصدى لانتهاكات الاحتلال الإسرائيلي. وأن المجلس التشريعي الفلسطيني لم يقم بدوره في مجالي حماية الأمن الإنساني وتحقيق التنمية المستدامة، ولا في الرقابة على السلطة الفلسطينية بمكوناتها الثلاث؛ رغم تورطها في مخالفة التشريعات الخاصة بالأمن الإنساني في فلسطين.
