|a صدر قانون حماية المستهلك العماني رقم 66 لسنة 2014، والذي يعتبر قانون حمائي ذو قواعد آمرة يضمن الحماية القانونية للمستهلك من طمع وجشع التجار، ولما كان العدول عن التعاقد يعتبر أحد الحقوق المشروعة التي أقرها المشرع لطرفي العقد قبل تمام نفاذه. فقد أجاز قانون حماية المستهلك العماني حق العدول كأحد الضمانات للمستهلك. إلا أن المشرع العماني في قانون حماية المستهلك لم يتطرق إلى حق العدول بلا سبب بشكل صريح كما نص عليه قانون حماية المستهلك المصري الصادر في عام 2018. وحيث أن عدم وضوح نص المادة 16 من قانون حماية المستهلك العماني يترك الباحث بحيرة منها فيما إذا كان يمكن التأويل أو الفهم على أن المشرع العماني أجاز حق العدول بغير سبب -كما فعل المشرع المصري في المادة 21 من قانون حماية المستهلك- والذي يستمد منه القانون العماني أغلب أحكامه أم لا، حيث لم يتبين في النص القصد من عبارة "أو الغرض الذي تم التعاقد من أجله". وعليه فقد ارتأينا دراسة وتحليل النصوص المتعلقة بحق العدول بغير سبب في القانون ذاته مع مقارنة لموقف المشرع المصري لمعرفة مدى إمكانية تطابق أحكام القانونين، ومدى كفاية نصوص حق العدول بغير سبب في قانون حماية المستهلك العماني، والنصوص المنظمة لها. استنادا لذلك فإن محاور الدراسة سترتكز على توضيح المقصود بماهية حق العدول بغير سبب وطبيعته والأساس القانوني له ومدى كفاية النصوص المنظمة لحق العدول بغير سبب في القانون العماني. حيث انتهت الدراسة إلى أن المشرع العماني لم يذكر صراحة حق العدول بغير سبب والذي يجعلنا نقول أنه لم يقر به حتى لو استندنا على أن المشرع العماني يستمد أحكامه من القانون المصري الذي أجاز حق العدول بغير سبب صراحة. حيث لا يمكن الاستناد على هذه الفكرة لتأويل نص المادة 16 من قانون حماية المستهلك العماني. وقد أوصت الدراسة بضرورة إيجاد معالجة تشريعية لحق العدول عن طريق تعديل القانون وذكر حق العدول بغير سبب صراحة كما نص عليه قانون حماية المستهلك المصري رقم 181 لعام 2018 ولكن في حدود يبينها القانون دون إطلاق العنان لما في ذلك من تأثير على استقرار العلاقات التعاقدية.

|b The Omani Consumer Protection Law No. 66 of 2014 was issued, which is considered a protective law with jus cogens that guarantees legal protection for the consumer from the greed and greed of merchants, and since the renunciation of the contract is considered one of the legitimate rights that the legislator approved for both parties to the contract before its entry into force. The Omani Consumer Protection Law permits the right of justice as one of the guarantees for the consumer. However, the Omani legislator in the consumer protection law did not refer to the right of justice without reason explicitly as stipulated by the Egyptian consumer protection law. As it is not clear the text of Article 16 of the Consumer Protection Law No. 66 of 2014, which in its content can be interpreted or understood as the Omani legislator authorized the right to justice without reason, as the Egyptian legislator did in Article 21 the Consumer Protection Law, from which the Omani law derives most of its provisions . Accordingly, we decided to study and analyze the texts related to the right of justice without a reason in the law itself, compared with the position of the Egyptian legislator to find out the extent to which the provisions of the two statutes are identical, the adequacy of the texts of the right of justice without reason in the Omani Consumer Protection Law, and the texts regulating them. Accordingly, the themes of the study will focus on clarifying the meaning of what is the right of justice without reason, its nature and the legal basis for it. And the adequacy of the texts regulating the right to justice without reason in Omani law. Where the study concluded that the Omani legislator did not explicitly mention the right of justice without a reason, which makes us say that he did not recognize it even if we relied on the fact that the Omani legislator derives its provisions from the Egyptian law, which explicitly authorized the right of justice without a reason. As it is not possible to rely on this idea to interpret the text of Article 16 of the Omani Consumer Protection Law. The study recommended the necessity of finding a legislative treatment for the right of justice by amending the law and mentioning the right of justice without an explicit reason as stipulated in the Egyptian Consumer Protection Law No. 181 of 2018.
