المستخلص: Originally, the administrative decisions are valid from their insuarace date against the administration, and from their publication or notification (advertising) against individuals. However, the administration’s will may subject the administrative decision in its validity to the occurrence of a future incident. Such incident may not be fulfilled, which is called a condition, or fulfilled within a period, which is called added to term. Thus, the effect of such decision is subject to the fulfilment of the condition or the fulfilment of the term. There fore, in order to understand the extent of the applicability of the administrative decisions that are subject to a condition and the effect of the condition on the administrative decisions, in addition to the extent of the applicability of the administrative decisions that are added to term and the effect of the term on the applicability of the administrative decisions, this research is divided to two sections: The first section includes the applicability of the administrative decisions that are subject to a condition, and the second one includes the applicability of the administrative decisions that are added to term.

الأصل أن القرارات الإدارية نافذة بتاريخ إصدارها في مواجهة الإدارة، ومن تاريخ نشرها أو تبليغها (إعلانها) في مواجهة الأفراد، إلا أنه قد تتجه إرادة الإدارة إلى تعليق سريان أو نفاذ القرار الإداري على وقوع حادثة مستقبلية، هذه الحادثة قد تكون غير محققة الوقوع فتسمى شرطا أو محققة الوقوع وتسمى آجلا، وبالتالي فإن آثار هذا القرار مرتبطة بتحقق الشرط الذي علقت عليه أو حلول الأجل المضاف إليه بدء نفاذه. ولمعرفة مدى نفاذ القرارات الإدارية المعلقة على شرط، وأثر الشرط على نفاذ القرار الإداري، وكذلك مدى نفاذ القرارات الإدارية المضافة إلى أجل، وأثر الأجل على بدء نفاذ القرار الإداري، فإننا وإجابة على ذلك نقسم الدراسة في هذا البحث إلى مبحثين نتناول في المبحث الأول نفاذ القرارات الإدارية المعلقة على شرط، ونخصص المبحث الثاني لدراسة نفاذ القرارات الإدارية المضافة إلى أجل.
