المستخلص: تسعى الورقة البحثية إلى تحليل دور المعارضة البرلمانية كآلية لتحسين وتطوير التشريعات من خلال تواجدها في البرلمان وهياكله وأجهزته المختصة في صناعة التشريع، بتوفير اقتراحات وخيارات وبدائل سياسات للحكومة القائمة بهدف ترقية القانون؛ ليستجيب لتطلعات المواطنين وأهداف التنمية الشاملة في ظل نظام سياسي مستقر، وقد طرحت الورقة البحثية سؤالا مركزيا حول مدى نجاح تجربة مشاركة المعارضة البرلمانية في أجهزة وهيئات البرلمان ودورها في تفعيل التشريع وتطويره وتجويده ضمن نظام سياسي عربي يعترف دستوريا بحقوق المعارضة البرلمانية (التجربة الجزائرية). وقد أظهرت نتائج الدراسة أن دسترة حقوق المعارضة البرلمانية وتمكينها من الحقوق والآليات لم يسهم بالقدر الكافي في إثراء الإنتاج التشريعي وجودته، بسبب إكراهات ثقافية وتنظيمية ظهرت أثناء الممارسة وفي العلاقات بين السلطات، وعليه اقترحت الورقة البحثية توصيات بضرورة تفعيل الدور التشريعي للمعارضة البرلمانية، بدءا بإصلاح النظام الحزبي وصولا إلى حوكمة برلمانية تقودها نخبة مؤهلة تمتلك خبرة تشريعية.

The research paper seeks to analyze the role of the parliamentary opposition as a mechanism for improving and developing legislation through its presence in parliament and its structures and specialized agencies in making legislation, by providing suggestions, options, and policy alternatives to the existing government to promote the law; In order to respond to the aspirations of citizens and the goals of comprehensive development in light of a stable political system. The research paper raised a central question about the extent of the success of the parliamentary opposition’s participation in parliament’s organs and bodies and its role in implementing, developing, and improving legislation within an Arab political system that constitutionally recognizes the rights of the parliamentary opposition (the Algerian experience). The study results showed that constitutionalizing the rights of the parliamentary opposition and its empowerment of rights and mechanisms did not sufficiently contribute to enriching the legislative production and its quality due to cultural and organizational constraints that appeared during practice and in the relations between the authorities. Accordingly, the research paper made recommendations for the necessity of implementing the legislative role of the parliamentary opposition, starting with the reform of the party system, leading to parliamentary governance led by a qualified elite with legislative experience.
