المستخلص: إن انتشار الصراعات بين الأديان والأعراق لا يعني فقط الهجمات ضد السكان المدنيين ولكن أيضا في كثير من الحالات، تدمير الأهداف أو الممتلكات ذات الخصائص المدنية التي تشكل التراث الثقافي. أعال التخريب أو تدمير الموجهة ضد هذه الممتلكات شائعة لا سيما في مثل هذه النزاعات، حيث أن مثل هذه الممتلكات عادتا ما تعتبر بمثابة رمز للهوية الثقافية وتاريخ للطرف الخصم، ولكن في نفس الوقت، تعتبر جزءا من التراث الإنساني. أن واجب الحماية هنا لا يقع على عاتق الدولة ذات العلاقة فحسب، بل إنها تشمل المجتمع الدولي ككل باعتبار أنه التزام اتجاه الكافة والذي بدوره يرتب المسؤولية الجنائية الدولي والفردية بالنسبة إلى الأطراف المخالفة.

La multiplication des conflits interreligieux et interethniques implique non seulement des attaques contre les populations civiles mais aussi, dans de nombreux cas, la destruction de biens de caractère civil qui constituent le patrimoine culturel. Les actes de vandalisme dirigés contre ces biens ou la destruction de ces biens sont particulière ment courants dans de tels conflits, où les biens culturels pouvant être considérés comme des symboles de l’identité culturelle et de l’histoire de la partie adverse, mais en même temps, font partie du patrimoine de l’humanité. Pour cela le devoir de le protéger ici ne repose pas sur l’Etat concerne seulement, mais aussi, il inclut la communauté internatic nale dans son ensemble, parce qu’il est considéré comme une ergomanes. Cela à son tour organise la responsabilité pénale internationale et individuelle par rapport aux partie en infraction.

The proliferation of interreligious and interethnic conflicts does not mean only attacks against the civilian population but also, in many cases, the destruction of objects or properties with civilian characteristics that constitute cultural heritage. Vandalism or destruction directed against such property is particularly common in such conflicts, as such property is usually considered a symbol of the opposing party's cultural identity and history, but at the same time, it is considered part of the human heritage. The duty to protect here does not fall to the relevant state only, but also includes the international community as a whole, considering that it is an erga omnes obligation, which in turn arranges international and individual criminal responsibility for the offending parties.
