المستخلص: يناقش هذا البحث الاتجاهات الحديثة في مجال مسؤولية المحكم بهدف ترجيح أحد هذه الاتجاهات على الأخرى بما يتفق وطبيعة التحكيم. ولهذا البحث مشكلة ينطلق منها تتمثل بتحديد المركز في القانون للمحكم، فهو يحتل مركزاً وسطاً بين اعتباره مهنياً أو قاضياً، فهو ليس مهنياً لأنه يقوم بعمل قضائي، كما أنه ليس قاضياً لأنه يختار من قبل الخصوم ويؤدي دور الشخص المهني.
وتأتى أهمية البحث من خلال بيان موقف القوانين الوطنية التي جاءت منقسمة بشأن تحديد مسؤولية المحكم بين من ينادي بفكرة المسؤولية المهنية، وبين من ينادي بفكرة المسؤولية القضائية. كما أن لهذا البحث أهدافاً يسعى إلى تحقيقها، ومن أهمها بيان موقف القانون الكويتي الذي جاء وسطاً بين هذه القوانين، بحيث أخذ بفكرة المسؤولية القضائية كأصل عام، وبفكرة المسؤولية المهنية كاستثناء على هذا الأصل وفي حالة واحدة.
وقد خلص البحث إلى عدة نتائج تمثلت أهمها بأن هناك من ينادي بالمسؤولية المدنية لهيئة التحكيم في حال أهملت القيام بواجباتها للنظر في النزاع والفصل فيه، وهناك من يذهب إلى معاملة هيئة التحكيم معاملة القاضي ويخضعها للمسؤولية القضائية من جهة، كما ويمنحها حصانة قضائية من جهة أخرى. وتأتي ثمرة البحث في التوصيات التي تتمثل بضرورة وضع قانون مستقل للتحكيم في الكويت، يعالج مسؤولية هيئة التحكيم القضائية، والابتعاد عن المسؤولية المهنية لهيئة التحكيم، لما يترتب على المسؤولية المهنية من آثار سلبية تتعارض مع الحكمة من اللجوء إلى التحكيم وطبيعته.


This research discusses recent trends in the area of arbitrator's liability with the aim of weighting one of these trends over the other that is consistent with the nature of the arbitration. This research is a problem from which to determine the status of the arbitrator in the law. He occupies a middle position between being considered a professional or a judge. He is not just professional because he performs judicial work, nor is he a judge because he is chosen by the litigants and performs the role of a professional person.
The importance of the research comes through outlining the position of national laws that are divided on the determination of the arbitrator's liability between those who advocate the idea of professional responsibility and those who advocate the idea of judicial responsibility. This research also has objectives that it seeks to achieve, the most important of which is the statement of the position of Kuwaiti law, which is an intermediate between these laws as it took the idea of judicial responsibility as a general reference, and the idea of professional responsibility as an exception to this reference and in one case.
The research concluded several findings, the most important of which was that there are those who advocate civil liability of the arbitral tribunal in the event that it fails to perform its duties to consider and adjudicate the dispute. There are those who treat the arbitral tribunal as a judge and subject it to judicial responsibility on the one hand and grant judicial immunity on the other. The result of research comes in the form of recommendations that consist the need to establish an independent arbitration law in Kuwait that addresses the liability of the judicial, arbitral tribunal and move away from the professional responsibility of the arbitral tribunal because the professional liability has negative effects that are incompatible with the wisdom and nature of recourse to arbitration.
