المستخلص: The thesis has talked, in the beginning, about the law of the marriage of the atheist with the Muslim, and stating the agreement of the scientists on the condition of the husband’s embracing Islam for the correctness of the marriage. The female believer shouldn’t be married from the atheist whether he is ethnically Jewish, Christian, pagan or a renegade atheist and whether the female Muslim is chaste or adulteress. As the thesis discusses the law of the sustainability of the marriage of the female Muslim with the ethnical atheist hoping for her to embrace Islam - whether before or after embracing - and mentioning the disagreement of the scientists in the sustainability of the marriage in the two cases, then stating the probable sayings. The thesis has discussed the law of the sustainability of the Muslim´s marriage with the atheist - if the atheism is incidental, that the husband has renounced - whether the renouncement before embracing or after it - and clarifying the disagreement of the scientists in the law of the sustainability of the marriage in hope of his returning to Islam. Then, stating the straight forwarding sayings. Then, the thesis has talked about the law of the sustainability of the marriage if the husband has embraced after the dissension and stating the straight forwarding sayings. Then, the thesis has talked about the legitimate effects incurred on departing the female Muslim for her non-Muslim husband from the truthfulness of the divorce between the two couples, and is the dissension considered as a divorce? And stating the straight forwarding sayings. then stating the law of the palimony in the time of the waiting period and stating the straight forwarding sayings. Then, it has discussed the law of the boys when the wife embraces Islam and also the husband remains on the atheism. Finally, the thesis has been ended with as conclusion including the results and recommendations.

تحدث البحث عن حكم زواج الكافر من المسلمة ابتداء، وذكر اتفاق العلماء على شرط إسلام الزوج لصحة النكاح، فلا يجوز إنكاح المؤمنة من الكافر، سواء كان أصلياً: يهودياً أو نصرانياً أو مجوسياً أو وثنياً، أو كان كافراً مرتداً، وسواء كانت المسلمة عفيفة أو زانية. كما تطرق لحكم استدامة زواج المسلمة بالكافر الأصلي طمعاً في إسلامه - سواء قبل الـدخول أم بعد الدخول - وذكر اختلاف العلماء في استدامة النكاح في الحالتين، ثم ذكر الراجح من الأقوال. ثم تطرق البحث لحكم استدامة نكاح المسلمة من الكافر - إذا كان الكفر طارئا، بأن ارتد الزوج - سواء كانت الردة قبل الدخول أو بعده - وذكر اختلاف العلماء في حكم استدامة الـزواج طمعاً في عودته للإسلام، ثم ذكر الصحيح من الأقوال. ثم تكلم البحث عن حكم بقاء النكاح إذا أسلم الزوج بعد انقضاء العدة، وذكر الصحيح من الأقوال. ثم تكلم عن الآثار الشرعية المترتبة على مفارقة المسلمة لزوجها غير المسلم من نوع الفرقة بين الزوجين، وهل تعد الفرقة فسخا أم طلاقاً؟ وذكر الصحيح من الأقوال، ثم ذكر حكم النفقة في زمن العدة وذكر القول الراجح، ثم تطرق لحكم الأولاد عند إسلام الزوجة وبقاء الزوج على الكفر، وبعده ختم البحث بخاتمة مع التوصية بتكرار البحث في هذه المسائل ومتابعة ما يستجد منها؛ لحاجة المسلمين إليها في كثير من البلاد التي هاجر إليها المسلمون.
